´Shurahbil bin Muslim Al-Khawlani said:` I heard Abu Umamah Al-Bahil say: “I heard the Messenger of Allah(ﷺ) say: “The guarantor is responsible and the debt must be repaid.' ”
Explanation & Benefits
Maulana Ataullah Sajid
Benefits and Issues:
➊
If a person guarantees for another that he will pay this debt, and he does not pay upon demand or at the appointed time, then the guarantor should pay the creditor from his own wealth, and later recover it from the debtor.
➋
It is necessary to pay off a debt in all circumstances, even if the debtor passes away; then the debt will be paid from his estate.
If the debt cannot be paid from the estate, then his heirs will pay it.
➌
The meaning of "ta'wan" (compensation) is that if the debtor does not pay the debt, then the guarantor fulfills this responsibility by paying the amount from his own wealth.
