Hadith 2381

حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ ، حَدَّثَنَا سُفْيَانُ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ طَاوُسٍ ، عَنْ حُجْرٍ الْمَدَرِيِّ ، عَنْ زَيْدِ بْنِ ثَابِتٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " جَعَلَ الْعُمْرَى لِلْوَارِثِ " .
´It was narrated from Zaid bin Thabit that :` the Prophet (ﷺ) ruled that a gift given for life belongs to the heirs (of the recipient).

1؎ : The meaning of the hadith is that by granting ‘umra, the item permanently leaves the ownership of the giver and becomes the property of the one to whom the ‘umra is given; after him, it will pass to his heirs. This is the view of the Ahl al-Hadith and the majority of scholars.

Benefits and Issues:
Whatever is given to someone for a lifetime will not return to the giver after the recipient’s death; rather, just as the rest of the deceased’s estate is distributed among his heirs, so too will the thing received in this manner be included in the inheritance and divided among his heirs. This is because, according to the Shariah, this item falls under the ruling of a gift (hiba), and therefore it will be considered the lawful property of the recipient.
