Hadith 2325

حَدَّثَنَا عَمْرُو بْنُ رَافِعٍ ، حَدَّثَنَا مَرْوَانُ بْنُ مُعَاوِيَةَ ، ح وَحَدَّثَنَا أَحْمَدُ بْنُ ثَابِتٍ الْجَحْدَرِيُّ ، حَدَّثَنَا صَفْوَانُ بْنُ عِيسَى ، قَالَا : حَدَّثَنَا هَاشِمُ بْنُ هَاشِمٍ ، عَنْ عَبْدِ اللَّهِ بْنِ نِسْطَاسٍ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ حَلَفَ بِيَمِينٍ آثِمَةٍ عِنْدَ مِنْبَرِي هَذَا فَلْيَتَبَوَّأْ مَقْعَدَهُ مِنَ النَّارِ وَلَوْ عَلَى سِوَاكٍ أَخْضَرَ " .
´It was narrated from Jabir bin 'Abdullah that the Messenger of Allah (ﷺ) said:` 'Whoever swears a false oath near this pulpit of mine, let him take his place in Hell, even if it is for a green twig.”

Brief Explanation
1؎ : From this hadith it is understood that taking a false oath at a blessed place is an even greater sin, although taking a false oath anywhere is itself a grave sin. Some scholars have said that the claimant has the choice to have the defendant swear an oath wherever he wishes and with whichever words he wishes. Others have said that the oath is only to be taken in the court, and that swearing by the name of Allah Ta'ala is sufficient; the claimant cannot compel for anything beyond this.

The Rawdah (Riyad al-Jannah) in the Prophet’s Mosque (Masjid Nabawi sallallahu alayhi wa sallam) and the Prophet’s pulpit (minbar), which will be at the Pond (Hawd) on the Day of Resurrection—
To lie or to swear a false oath without regard for such great and blessed places is a sign of extreme wretchedness.
The same ruling applies to ordinary mosques as well.
This further increases the seriousness of taking an oath therein.

«أخرجه أبوداود، الأيمان والنذور، باب ما جاء في تعظيم اليمين عند منبر النبي صلي الله عليه وسلم، حديث:3246، والنسائي في الكبرٰي:3 /491، حديث:6018، وأحمد:2 /329، وابن حبان(الإحسان):6 /281، حديث:4353.»©Explanation:
In this hadith, there is a warning that the higher the rank and virtue of a place, the greater will be the punishment for committing a sin there.
Similarly, those times whose virtue has been mentioned—such as after ‘Asr and on the day of Jumu‘ah and the night of Jumu‘ah—if a sin is committed during them, its punishment will also be relatively greater and more severe.
