Hadith 2242

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، وَعَلِيُّ بْنُ مُحَمَّدٍ ، قَالَا : حَدَّثَنَا وَكِيعٌ ، عَنْ ابْنِ أَبِي ذِئْبٍ ، عَنْ مَخْلَدِ بْنِ خُفَافِ بْنِ إِيمَاءَ بْنِ رَحَضَةَ الْغِفَارِيِّ ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ ، عَنْ عَائِشَةَ ، " أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى ، أَنَّ خَرَاجَ الْعَبْدِ بِضَمَانِهِ " .
´It was narrated from Aishah that :` the Messenger of Allah (ﷺ) ruled that what a slave earns belongs to his guarantor.

Brief Explanation
1؎: The situation regarding this issue is as follows: A person purchased a slave, and the slave remained with him for several days. Then, due to a defect or on the basis of a stipulated option (khiyar), he returned the slave. Thus, the earnings accrued during the days the slave was with the buyer will belong to the buyer, because during those days the buyer was the guarantor (dhamin) for the slave. If the slave had perished while with the buyer, the loss would have been borne by the buyer, not by the seller.
