(1) This contradiction exists in both the chain of narration and the text. The contradiction in the text is clear; as for the chain, the contradiction is that Mu‘ammar said “from al-Hasan, the freed slave of Banu Nawfal,” which is an error. The correct version is “Abu al-Hasan, the freed slave of Banu Nawfal,” as is found in the previous narration of ‘Ali ibn Mubarak.
(2) Attributing the aforementioned error to Mu‘ammar is questionable. Imam Mizzi rahimahullah writes in Tuhfat al-Ashraf: “It is questionable to attribute this error to Mu‘ammar or his student ‘Abd al-Razzaq, because Imam Ahmad ibn Hanbal, Muhammad ibn ‘Abd al-Malik ibn Zanjuyah, and many others narrate this report with the chain ‘from ‘Abd al-Razzaq, from Mu‘ammar,’ but all of them say ‘from Abu al-Hasan’ (which is correct; only in al-Nasa’i is it ‘from al-Hasan’). Therefore, this slip was either made by Imam al-Nasa’i rahimahullah himself or by his teacher Muhammad ibn Rafi‘.” And Allah knows best. See: (Tuhfat al-Ashraf bi Ma‘rifat al-Atraf: 5/274). That is, Mu‘ammar’s narration is also “from Abu al-Hasan,” just like that of ‘Ali ibn Mubarak. Mu‘ammar did not contradict ‘Ali ibn Mubarak, and the author’s indication towards Mu‘ammar’s error is not correct; rather, the error was made by someone else—either Imam al-Nasa’i rahimahullah or his teacher Muhammad ibn Rafi‘. (3) A free man has the right to pronounce three divorces (talaq), but a slave has the right to two divorces. The narrator of the hadith also had this right, so he could have taken her back. And if the waiting period (‘iddah) had passed, then they could have contracted a new marriage. It is possible that he pronounced two divorces together; in that case, they would be considered as one, and he would have the right to take her back. Then the meaning would be: “If you take her back, she will return to you, and one divorce will have occurred to her.” And Allah knows best. In any case, both this narration and the next are weak.
