Hadith 2080

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ ، حَدَّثَنَا أَبُو عَاصِمٍ ، حَدَّثَنَا ابْنُ جُرَيْجٍ ، عَنْ مُظَاهِرِ بْنِ أَسْلَمَ ، عَنِ الْقَاسِمِ ، عَنْ عَائِشَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " طَلَاقُ الْأَمَةِ تَطْلِيقَتَانِ ، وَقُرْؤُهَا حَيْضَتَانِ " . (حديث موقوف) (حديث مرفوع) قَالَ أَبُو عَاصِمٍ : فَذَكَرْتُهُ لِمُظَاهِرٍ ، فَقُلْتُ : حَدِّثْنِي كَمَا حَدَّثْتَ ابْنَ جُرَيْجٍ ، فَأَخْبَرَنِي : عَنَ الْقَاسِمِ ، عَنْ عَائِشَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " طَلَاقُ الْأَمَةِ تَطْلِيقَتَانِ ، وَقُرْؤُهَا حَيْضَتَانِ " .
´It was narrated from 'Aishah that the Prophet (ﷺ) said:` "The divorce of a slave woman is twice, and her (waiting) period is two menstrual cycles." Abu 'Asim said: "I mentioned this to Muzahir and said: 'Tell me what you told Ibn Juraij.' So he told me, narrating from Qasim from 'Aishah, that the Prophet (ﷺ) said: 'The divorce of a slave woman is twice, and her (waiting) period is two menstrual cycles."'

Benefits and Issues:
Imam Malik has mentioned in the Muwatta the legal verdicts (fatawa) of Hazrat Uthman, Hazrat Zayd bin Thabit, and Hazrat Abdullah bin Umar (radi Allahu anhum) that a slave (ghulam) can issue two divorces (talaq), and the waiting period (‘iddah) for a slave-woman (bondwoman) is two menstrual cycles. That is, in the matter of divorce, the status of the husband—whether he is free or a slave—will be considered, and in the matter of ‘iddah, the status of the woman will be considered. Meaning, the waiting period for a free woman is three menstrual cycles, and for a slave-woman, it is two menstrual cycles. (Muwatta Imam Malik, Book of Divorce, Chapter: What Has Been Narrated Regarding the Divorce of a Slave: 2/118)

In any case, both of the aforementioned hadiths are weak; however, from the reports of the Companions (athar al-sahabah), it is established that if a slave divorces his wife—whether the wife is free or a slave—then for him, two divorces will be equivalent to three divorces.

And after issuing them at different times, he cannot take her back (ruju‘) until that divorced woman marries someone else in a proper marriage.
