Hadith 2071

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى ، حَدَّثَنَا حَيْوَةُ بْنُ شُرَيْحٍ الْحَضْرَمِيُّ ، عَنْ ضَمْرَةَ بْنِ رَبِيعَةَ ، عَنِ ابْنِ عَطَاءٍ ، عَنْ أَبِيهِ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " أَرْبَعٌ مِنَ النِّسَاءِ لَا مُلَاعَنَةَ بَيْنَهُنَّ النَّصْرَانِيَّةُ تَحْتَ الْمُسْلِمِ ، وَالْيَهُودِيَّةُ تَحْتَ الْمُسْلِمِ ، وَالْحُرَّةُ تَحْتَ الْمَمْلُوكِ ، وَالْمَمْلُوكَةُ تَحْتَ الْحُرِّ " .
´It was nanated from 'Amr bin Shu'aib, from his father, from his grandfather, that:` the Prophet (ﷺ) said: "There are four kinds of women for whom there is no Li'an: a Christian woman married to a Muslim, a Jewish woman married to a Muslim, a free woman married to a slave, and a slave woman married to a free man."

Brief Explanation
1؎: However, in the third case, the slave will be subjected to the hadd (prescribed punishment) for qadhf (false accusation of adultery), and in the remaining cases, neither li‘an (mutual cursing) will take place nor will the husband be subjected to the hadd. The point is that li‘an becomes necessary when the accusation is against a believing (mu’minah) and free woman; if the woman is a disbeliever (kafirah), or a slave-girl (bondwoman), or she has already been subjected to the hadd, then li‘an will not take place.
