Hadith 1952

حَدَّثَنَا أَحْمَدُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ ، حَدَّثَنَا هُشَيْمٌ ، عَنْ ابْنِ أَبِي لَيْلَى ، عَنْ حُمَيْضَةَ بِنْتِ الشَّمَرْدَلِ ، عَنْ قَيْسِ بْنِ الْحَارِثِ ، قَالَ : أَسْلَمْتُ وَعِنْدِي ثَمَانِ نِسْوَةٍ ، فَأَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقُلْتُ : ذَلِكَ لَهُ ، فَقَالَ : " اخْتَرْ مِنْهُنَّ أَرْبَعًا " .
´It was narrated that Qais bin Harith said:` “I became Muslim and I had eight wives. I went to the Prophet and told him about that. He said: 'Choose four of them.' ”

Brief Explanation
1؎ : From this hadith it is understood that a marriage contracted during the time of disbelief (kufr) is considered valid; if both husband and wife accept Islam, their previous marriage remains intact and there is no need to renew the marriage contract. This is the view of Imam Malik, Imam Shafi'i, and Imam Ahmad rahimahumullah. It is also understood from this that, at the time of separation, the chronological order of marriages is not consequential; it is not necessary for the man to retain his first wife, rather, he has the choice to retain whomever he wishes and to separate from whomever he wishes. This hadith and the subsequent ahadith are proofs against the Hanafi position.
