Hadith 1940

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا مُحَمَّدُ بْنُ بِشْرٍ ، حَدَّثَنَا ابْنُ أَبِي عَرُوبَةَ ، عَنْ قَتَادَةَ ، عَنْ أَبِي الْخَلِيلِ ، عَنْ عَبْدِ اللَّهِ بْنِ الْحَارِثِ ، أَنَّ أُمَّ الْفَضْلِ حَدَّثَتْهُ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لَا تُحَرِّمُ الرَّضْعَةُ وَلَا الرَّضْعَتَانِ أَوِ الْمَصَّةُ وَالْمَصَّتَانِ " .
´It was narrated that Umm Fadl said:` that the Messenger of Allah said: “Breastfeeding once or twice, or suckling once or twice, does not make (marriage) unlawful.”

Brief Explanation
1؎: When a child takes the mother’s breast into his mouth and suckles, then, without any impediment, leaves the breast of his own will and pleasure, this is called «رَضْعَۃٌ». And «مصّۃ»: is derived from «مصّ», which means “to suck.” The meanings of both «مصۃ» and «رَضْعَۃٌ» are the same. There is a difference of opinion regarding how much milk must be drunk for the ruling of suckling (rada‘ah) to be established. The majority (jumhur) hold that this ruling is established whether a little or a lot of milk is drunk. Dawud al-Zahiri, and according to one narration Ahmad, as well as Ishaq Rahwayh, Abu ‘Ubayd, and others, have deduced from the implied meaning (mafhum mukhalafah) of this hadith (i.e., that prohibition is not established by suckling or drinking twice, so it means that by doing so three times, prohibition will be established) that the ruling of suckling is established by three instances of drinking, not by two. Imam al-Shafi‘i says that the suckling which establishes prohibition is that which occurs five times; his evidence is the narration of Umm al-Mu’minin ‘A’ishah radi Allahu anha, which will come ahead. The evidence of the majority is the noble verse: «امهاتكم اللآتى ارضعنكم».

Benefits and Issues:
➊ The Messenger of Allah (sallallahu alayhi wa sallam) stated this blessed saying in response to a question from a man. This incident is narrated in detail in Sahih Muslim. Umm al-Fadl (radi Allahu anha) said: The Prophet of Allah (sallallahu alayhi wa sallam) was present in my house when a Bedouin came to him. He said: O Prophet of Allah! I had a woman in my marriage, and while she was still with me, I married another woman. My first wife claims that she has breastfed my new wife once or twice. At that, the Prophet (sallallahu alayhi wa sallam) stated the above-mentioned ruling. (Sahih Muslim, Kitab al-Rada‘, Chapter: Regarding One Suckling and Two Sucklings, Hadith: 1451)

Some scholars have deduced from this hadith that the rulings of breastfeeding (rada‘ah) are established by three instances of suckling, meaning that the milk relationship is established. However, the correct view is that prohibition (of marriage) is established by five instances of suckling, as narrated in Sahih Muslim from Aisha (radi Allahu anha) that initially, the ruling of prohibition through breastfeeding was revealed in the Qur’an for ten instances of suckling, then it was abrogated and the ruling was revealed for five instances of suckling. This narration is authentic and explicit that the prohibition of suckling (raḍā‘ah) is not established by one or two instances of breastfeeding, rather it requires more instances. In view of the previous hadith, the maximum intended is five times, so that all the ahadith can be acted upon.
