Hadith 1872

حَدَّثَنَا عِيسَى بْنُ حَمَّادٍ الْمِصْرِيُّ ، أَنْبَأَنَا اللَّيْثُ بْنُ سَعْدٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي حُسَيْنٍ ، عَنْ عَدِيِّ بْنِ عَدِيٍّ الْكِنْدِيِّ ، عَنْ أَبِيهِ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الثَّيِّبُ تُعْرِبُ عَنْ نَفْسِهَا ، وَالْبِكْرُ رِضَاهَا صَمْتُهَا " .
´It was narrated from Adi bin Adi Al-Kindi that:` his father said: “The Messenger of Allah said: 'A previously-married woman can speak for herself, and the consent of a virgin is her silence.' ”

Brief Explanation
1؎: For a previously married woman (thayyib), remaining silent is not sufficient; rather, she must verbally say "yes" or "no." Here, by "virgin" (bikr) and "previously married woman" (thayyib), what is meant is a girl who has reached adulthood and maturity. However, for a minor girl, it is not necessary to seek her permission; rather, the guardian's (wali's) consent is sufficient. For example, Abu Bakr as-Siddiq radi Allahu anhu married his daughter, the Mother of the Believers Aisha radi Allahu anha, to the Prophet sallallahu alayhi wa sallam, and at that time, the Mother of the Believers Aisha radi Allahu anha was only six years old.

Her marriage will be conducted by her guardian (wali); however, her opinion should also be given importance.
The marriage will take place with the consultation of both.
