Hadith 1864

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا حَفْصُ بْنُ غِيَاثٍ ، عَنْ حَجَّاجٍ ، عَنْ مُحَمَّدِ بْنِ سُلَيْمَانَ ، عَنْ عَمِّهِ سَهْلِ بْنِ أَبِي حَثْمَةَ ، عَنْ مُحَمَّدِ بْنِ مَسْلَمَةَ ، قَالَ : خَطَبْتُ امْرَأَةً ، فَجَعَلْتُ أَتَخَبَّأُ لَهَا ، حَتَّى نَظَرْتُ إِلَيْهَا فِي نَخْلٍ لَهَا ، فَقِيلَ لَهُ : أَتَفْعَلُ هَذَا وَأَنْتَ صَاحِبُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ ، فَقَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " إِذَا أَلْقَى اللَّهُ فِي قَلْبِ امْرِئٍ خِطْبَةَ امْرَأَةٍ ، فَلَا بَأْسَ أَنْ يَنْظُرَ إِلَيْهَا " .
´It was narrated that:` Muhammad bin Salamah said: “I proposed marriage to a woman, then I hid and waited to see her until I saw her among some date palm trees that belonged to her.” It was said to him: “Do you do such a thing when you are a companion of the Messenger of Allah?” He said: “I heard the Messenger of Allah saying: 'When Allah causes a man to propose to a woman, there is nothing wrong with him looking at her.' ”

Brief Explanation
1؎: Because this is looking at a time of necessity, and in times of necessity, such action is permissible—just as it is correct and permissible for a judge and witnesses to look at a woman, similarly, it is permissible for a physician to look at the area that needs to be seen for treatment. This is the view of Ahl al-Hadith, al-Shafi‘i, Abu Hanifah, Ahmad, and the majority of scholars: that it is permissible to look at a woman whom one intends to marry. Imam Malik says that this is correct with the woman's permission; without her permission, it is not correct. And there is another narration from him that it is not correct at all. In this chapter, there is this hadith, the second is the hadith of Mughira radi Allahu anhu which is coming ahead, and the third is the hadith of Abu Hurairah radi Allahu anhu which is in Sahih Muslim: that a man came to the Prophet sallallahu alayhi wa sallam and said, "I have intended to marry an Ansari woman." The Prophet sallallahu alayhi wa sallam said, "Have you seen her?" He replied, "No." The Prophet sallallahu alayhi wa sallam said, "Go and look at her, for there is something in the eyes of the women of the Ansar." It happened just as the Prophet sallallahu alayhi wa sallam said, and there was great harmony with that woman.

It is permissible to look at a woman whom one intends to marry.
It is also permissible for a woman to look at a man.
Although there is no hadith narrated specifically about this, by analogy with the ruling for men, it can be said that it is permissible for a woman to look at a man as well.
It is not necessary that the woman be aware of being looked at; rather, it is permissible to look at her even if she is unaware, provided the opportunity arises.
If it is not possible to see her oneself, then a trustworthy woman may be sent to the girl’s house, and she should observe the girl while keeping in mind the man’s preferences and likes.
