Hadith 1801

حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ ، حَدَّثَنَا وَكِيعٌ ، حَدَّثَنَا شَرِيكٌ ، عَنْ عُثْمَانَ الثَّقَفِيِّ ، عَنْ أَبِي لَيْلَى الْكِنْدِيِّ ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ ، قَالَ : " جَاءَنَا مُصَدِّقُ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخَذْتُ بِيَدِهِ ، وَقَرَأْتُ فِي عَهْدِهِ ، لَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ ، وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ ، فَأَتَاهُ رَجُلٌ بِنَاقَةٍ عَظِيمَةٍ مُلَمْلَمَةٍ فَأَبَى أَنْ يَأْخُذَهَا ، فَأَتَاهُ بِأُخْرَى دُونَهَا فَأَخَذَهَا ، وَقَالَ : أَيُّ أَرْضٍ تُقِلُّنِي ، وَأَيُّ سَمَاءٍ تُظِلُّنِي ، إِذَا أَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَقَدْ أَخَذْتُ خِيَارَ إِبِلِ رَجُلٍ مُسْلِمٍ " .
´It was narrated that:` Suwaid bin Ghafalah said: ”The Zakah collector of the Prophet came to us, and I took him by the hand and read in his order: 'Do not gather separate herds and do not separate herd for fear of Sadaqah'. A man brought him a huge, fat she-camel, but he refused to accept it. So he brought him another of lower quality and he accepted it. He said: 'What land would shelter me, if I came to the Messenger of Allah having taken the nest of a Muslim man's camels?' ”

Benefits and Issues:

The mentioned narration has been declared weak in chain (sanadan da'if) by our esteemed researcher, whereas some other scholars have graded it as sahih (authentic) and some as hasan (good), and they have mentioned its corroborating narrations (mutaba'at) and supporting evidences (shawahid). From this, it is understood that despite the narration being weak in its chain, it is still actionable and a valid proof.

Hazrat Suwayd bin Ghaflah rahimahullah had accepted Islam during the blessed life of the Messenger of Allah sallallahu alayhi wa sallam, but he was not able to see the Messenger of Allah sallallahu alayhi wa sallam.
He reached Madinah al-Munawwarah at a time when the noble Companions had already completed the burial of the Prophet sallallahu alayhi wa sallam, and for this reason, he is not counted among the Companions (Sahabah). However, he is included among the senior Followers (Kibar Tabi'in), who had the honor of seeing and meeting many of the Companions.


“The official came to us” means he came to collect the zakat from our tribe.
Hazrat Suwayd bin Ghaflah rahimahullah belonged to the Jufi tribe.


By “written order” is meant the document that the Messenger of Allah sallallahu alayhi wa sallam had written and given to the official so that zakat would be collected according to it.
Hazrat Suwayd radi Allahu anhu met this Companion and personally read the written instructions of the Prophet sallallahu alayhi wa sallam.


In zakat, property of a middle grade should be collected; neither should the best animal be taken, which would harm the owner, nor should a completely useless animal be taken, from which a poor person would not benefit at all.


When the Companions were appointed to any position, they were extremely mindful of justice and fairness.
