Brief Explanation
1؎: It is not disliked (makruh) for a fasting person to use the tooth-stick (miswak), whether at the beginning of the day or at its end; rather, it is a Sunnah. This is the view of the majority of scholars. Some people have considered it disliked to use the miswak after the sun has passed its zenith (zawal) on the grounds that it removes the odor from the mouth, the virtue of which has been mentioned in the hadith. However, it should be made clear that this odor is not related to the mouth, but rather to the stomach, which arises when the stomach is empty. This is what is referred to in Arabic as «خلوف», which is mentioned in the hadith.

Benefit: Although this narration is weak in its chain of transmission, the use of the tooth-stick (miswak) while fasting is established from authentic narrations, and it does not affect the fast. Imam Bukhari rahimahullah, in Sahih al-Bukhari, in the Book of Fasting, has titled a chapter as follows: (Chapter: The Use of Fresh and Dry Tooth-Stick for the Fasting Person). That is, the fasting person may use a fresh or dry miswak. After this, he mentions that it is reported from Hazrat ‘Amir ibn Rabi‘ah radi Allahu anhu that he said: I have seen the Messenger of Allah sallallahu alayhi wa sallam using the miswak while fasting so many times that I cannot count them.
