Hadith 1520

حَدَّثَنَا مُحَمَّدُ بْنُ الصَّبَّاحِ ، أَنْبَأَنَا يَحْيَى بْنُ الْيَمَانِ ، عَنْ مِنْهَالِ بْنِ خَلِيفَةَ ، عَنْ عَطَاءٍ ، عَنْ ابْنِ عَبَّاسٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَدْخَلَ رَجُلًا قَبْرَهُ لَيْلًا ، وَأَسْرَجَ فِي قَبْرِهِ " .
It was narrated from Ibn ‘Abbas that the Messenger of Allah (ﷺ) placed a man in his grave at night, and he lit a lamp in his grave.

Benefits and Issues:
➊ The mentioned narration has been declared weak in its chain by our esteemed researcher. However, Imam Tirmidhi rahimahullah and Shaykh al-Albani rahimahullah have graded it as hasan. Furthermore, Shaykh al-Albani rahimahullah has also mentioned other supporting evidences for it. See: (Ahkam al-Jana'iz, p. 108). Therefore, burying at night is permissible in case of necessity. This ruling is also established from the hadith that will be mentioned later. As our Shaykh has, based on the hadith of Sahih Muslim (934), considered it authoritative and actionable. ➋ It is permissible to light a lamp or similar source of light at the time of burial at night, even if the lamp has to be taken inside the grave. What is prohibited is lighting a lamp on top of the grave after the burial.

Explanation:
1:
The evidence of those people for the chapter is this very hadith, but this hadith is weak and not suitable as evidence.

2:
This is also the view of Imam Shafi‘i rahimahullah, Imam Ahmad rahimahullah, and the majority of scholars, and in terms of evidence, this is also the stronger and more correct opinion. Their evidence is the narration of Abu Ishaq al-Sabi‘i that ‘Abdullah ibn Yazid radi Allahu anhu lowered the deceased into the grave from the side of his feet and said: "This is the Sunnah method." An objection is raised against this narration that Abu Ishaq al-Sabi‘i suffered from confusion in his later years and also practiced tadlis, so this narration is also not suitable as evidence. However, this objection is not correct because this narration from Abu Ishaq al-Sabi‘i has been narrated by Shu‘bah, and the narrations of Abu Ishaq al-Sabi‘i that come through Shu‘bah are considered to be based on direct hearing (mahmul ‘ala al-sama‘), even if they are in the form of ‘an‘anah, because Shu‘bah only took hadith from his teachers that were authentic.

3:
Hasan al-Basri inclined towards disapproval and used as evidence the hadith of Jabir in which it is stated: "The Prophet sallallahu alayhi wa sallam forbade that a man be buried at night until the funeral prayer is offered over him" (narrated by Muslim). The answer given to this is that this prohibition was due to the funeral prayer not being performed, not because of burial at night, or because people used to bury at night in order to provide an inferior shroud. Therefore, if there is no fear of these things, then there is no harm in burial at night. The burial of the Prophet sallallahu alayhi wa sallam itself took place at night, as Ahmad rahimahullah has narrated from ‘A’ishah radi Allahu anha. Similarly, the burial of Abu Bakr and ‘Umar also took place at night, and the burial of Fatimah radi Allahu anha was also carried out at night.
