Hadith 818
عن ابن عمر رضي الله عنهما أن رسول الله صلى الله عليه وآله وسلم قال: « ما حق امرىء مسلم له شيء يريد أن يوصي فيه يبيت ليلتين إلا ووصيته مكتوبة عنده ». متفق عليه.
Narrated Ibn 'Umar (RA): Allah's Messenger (ﷺ) said: "It is not permissible for a Muslim person, who has something he wants to give as a bequest, to have it for two nights without having his will regarding it written and kept ready with him." [Agreed upon].
Hadith 819
وعن سعد بن أبي وقاص رضي الله تعالى عنه قال : قلت : يا رسول الله أنا ذو مال ولا يرثني إلا ابنة لي واحدة أفأتصدق بثلثي مالي ؟ قال : « لا » قلت: أفأتصدق بشطره ؟ قال: « لا » قلت : أفأتصدق بثلثه ؟ قال : « الثلث ، والثلث كثير ، إنك أن تذر ورثتك أغنياء خير من أن تذرهم عالة يتكففون الناس ». متفق عليه.
Narrated Sa'd bin Abi Waqqas (RA): I said, "O Allah's Messenger, I have wealth and no one to inherit from me except my one daughter. Shall I give two-thirds of my property as Sadaqah?" He replied, "No." I said, "Shall I give half of it as Sadaqah?" He replied, "No." I said, "Shall I give a third of it as Sadaqah?" He replied, "You may give a third as Sadaqah, which is still a lot. To leave your heirs rich is better than to leave them poor and begging from people." [Agreed upon].
Hadith 820
عن عائشة أن رجلا أتى النبي صلى الله عليه وآله وسلم فقال : يا رسول الله إن أمي افتلتت نفسها ولم توص وأظنها لو تكلمت تصدقت أفلها أجر إن تصدقت عنها؟ قال:« نعم». متفق عليه . واللفظ لمسلم.
Narrated 'Aishah (RA): A man came to the Prophet (ﷺ) and said, "O Allah's Messenger, my mother had died suddenly, and did not make a will. And I think she would have given out Sadaqah if she had been able to speak, so will she get a reward if I gave out Sadaqah on her behalf?" He replied, "Yes." [Agreed upon; the wording is Muslim's].
Hadith 821
و عن أبي أمامة الباهلي رضي الله تعالى عنه قال : سمعت رسول الله صلى الله عليه وآله وسلم يقول : « إن الله قد أعطى كل ذي حق حقه فلا وصية لوارث». رواه أحمد والأربعة إلا النسائي ، وحسنه أحمد والترمذي ، وقواه ابن خزيمة وابن الجارود ، ورواه الدارقطني من حديث ابن عباس رضي الله عنهما وزاد في آخره:« إلا أن يشاء الورثة ». وإسناده حسن.
Narrated Abu Umamah al-Bahili (RA): I heard Allah's Messeneger (ﷺ) saying, "Allah has appointed for everyone who has a right what is due to him, and no Wasiyah (will) should be made to an heir." [Reported by Ahmad and al-Arba'a except an-Nasa'i. Ahmad and at-Tirmidhi graded it Hasan (good), while Ibn Khuzaimah and Ibn al-Jarud graded it Qawiy (strong)]. ad-Daraqutni reported the aforesaid Hadith from the narration of Ibn 'Abbas (RA); and he added in its end: "unless the other heirs wish so." [Its chain of narrators is Hasan (good)].
Hadith 822
وعن معاذ بن جبل رضي الله تعالى عنه قال : قال رسول الله صلى الله عليه وآله وسلم : « إن الله تصدق عليكم بثلث أموالكم عند وفاتكم زيادة في حسناتكم». رواه الدارقطني وأخرجه أحمد والبزار من حديث أبي الدرداء ، وابن ماجه من حديث أبي هريرة ، وكلها ضعيفة ، لكن قد يقوي بعضها بعضا ، والله أعلم.
Narrated Mu'adh bin Jabal (RA): The Prophet (ﷺ) said: "Allah gave (a favor) as Sadaqah to you a third of your property, when you are about to die, as an increase in your good deeds." [Reported by ad-Daraqutni]. Ahmad and al-Bazzar reported the aforesaid narration from the Hadith of Abu ad-Darda. While Ibn Majah reported it from the Hadith of Abu Hurairah (RA). All of them (i.e. these three chains of narrators) are weak. However, they may strengthen one another (becoming Hasan), and Allah Knows Best.
