وعن عمرو بن شعيب عن أبيه عن جده قال : قال رسول الله صلى الله عليه وآله وسلم : « ليس للقاتل من الميراث شيء ». رواه النسائي والدارقطني وقواه ابن عبد البر وأعله النسائي . والصواب وقفه على عمرو.
Narrated 'Amr bin Shu'aib on his father's authority from his grandfather (RA): Allah's Messenger (ﷺ) said: "One who kills a man cannot inherit anything from him." [Reported by an-Nasa'i and ad-Daraqutni. Ibn 'Abdul-Barr graded it Qawiy (strong), while an-Nasa'i declared it to be defective. The right opinion is that it is Mawquf (a saying of a Companion) from 'Umar].

According to this hadith, the killer is not entitled to receive anything from the inheritance of the murdered person. Most scholars hold the opinion that whether the killing was intentional (qatl ‘amd) or accidental (qatl khata’), the killer will not receive anything from the original wealth nor from the blood money (diyah). However, Imam Malik rahimahullah says that if the killing was accidental, then the killer will not receive anything from the blood money (diyah), but he will inherit from the rest of the wealth. Yet, we have not found any evidence for this position.
