Hadith 799

عن أنس قال : مر النبي صلى الله عليه وآله وسلم بتمرة في الطريق فقال : « لولا أني أخاف أن تكون من الصدقة لأكلتها ». متفق عليه.
Narrated Anas (RA): The Prophet (ﷺ) came upon a date on the road and said, "Were it not that I fear it may be part of the Sadaqah I would eat it." [Agreed upon].

«أخرجه البخاري، اللقطة، باب إذا وجد تمرة في الطريق، حديث:2431، ومسلم، الزكاة، باب تحريم الزكاة علي رسول الله صلي الله عليه وسلم وعلي أله، حديث:1071.»©Explanation:
➊ This hadith is evidence that if a lost item (luqatah) is insignificant, then it is permissible to benefit from it, and it is not necessary for the one who picks it up to continue announcing it.
➋ There are two types of luqatah: one is that the item is completely insignificant.
The legal ruling regarding this is that it may be picked up and used.
The second is that the item is valuable.
Regarding this, the Prophetic instruction is: “He should announce it for a year.”
In our times, announcements can be made through newspapers, television, radio, etc., and at large gatherings outside mosques.
If some expenses are incurred in the form of advertisements, they may be recovered from the owner of the lost item if he comes forward; otherwise, from one’s own pocket.
Even after announcing for a year, if the original owner is not found, then it may be put to use.
Still, its distinguishing marks and signs should be memorized or noted down, so that if the original owner comes later, its value may be paid to him, or the owner may himself forgo it.
