Hadith 793
وعن جابر رضي الله عنه قال : قال رسول الله صلى الله عليه وآله وسلم : « العمرى لمن وهبت له ». متفق عليه. ولمسلم : « أمسكوا عليكم أموالكم ولا تفسدوها فإنه من أعمر عمرى فهي للذي أعمرها حيا وميتا ولعقبه ». وفي لفظ : إنما العمرى التي أجازها رسول الله صلى الله عليه وآله وسلم أن يقول: هي لك ولعقبك فأما إذا قال : هي لك ما عشت فإنها ترجع إلى صاحبها .ولأبي داود والنسائي: «لا ترقبوا ولا تعمروا فمن أرقب شيئا أو أعمر شيئا فهو لورثته».
Narrated Jabir (RA): Allah's Messenger (ﷺ) said: "What is given in life-tenancy belongs to the one to whom it is given." [Agreed upon]. Muslim has: "Keep your properties for yourselves and do not squander them, for if anyone gives a life-tenancy it goes to the one to whom it is given, both during his life and after his death, and to his descendants." A narration has: "The life-tenancy which Allah's Messenger (ﷺ) allowed was only that in which one says, 'It is for you and your descendants.' However, if he says, 'It is yours as long as you live', it returns to its owner." Abu Dawud and an-Nasa'i have: "Do not give property "to go to the survivor" and do not give "life-tenancy", for if anyone is given either, the property goes to his heirs."
