عن حنظلة بن قيس رضي الله عنه قال : سألت رافع بن خديج عن كراء الأرض بالذهب والفضة ؟ فقال : لا بأس به إنما كان الناس يؤاجرون على عهد رسول الله صلى الله عليه وآله وسلم على الماذيانات وأقبال الجداول وأشياء من الزرع فيهلك هذا ويسلم هذا ويسلم هذا ويهلك هذا ولم يكن للناس كراء إلا هذا فلذلك زجر عنه فأما شيء معلوم مضمون فلا بأس به. رواه مسلم. وفيه بيان لما أجمل في المتفق عليه من إطلاق النهي عن كراء الأرض.
Narrated Hanzala bin Qais (RA): I asked Rafi' bin Khadij (RA) about renting land for gold and silver and he replied, "There is no harm in that, as the people used to rent land in the time of Allah's Messenger (ﷺ) for what grew by the river-beds, and the edges of the brooks/streams, or for a portion of the crop. However, sometimes this portion of the crop would be destroyed while the other is saved, or vice-versa. Thus, there would be no wages to pay the people (the owners of the land) except for the portion which produced a crop." For this reason, he warned against this (practice). However, if it is (rented) for something known and guaranteed, then there is no harm in it. [Muslim reported it]. This narration contains a clarification of what was mentioned in general terms in the previous narration of al-Bukhari and Muslim, regarding the general prohibition of renting out land.

This hadith prohibits that form of musaqat and muzara‘ah in which the yield and its quantity are unknown.
People used to stipulate invalid conditions.
These have been prohibited.
At times, it would happen that the produce around rivers, streams, and pathways would remain intact while the rest of the crop would be destroyed, and the sharecropper would receive nothing at all.
In such a situation, there is deception, fraud, and severe risk, which is why it has been prohibited.
