Hadith 766

عن حكيم بن حزام رضي الله عنه : أنه كان يشترط على الرجل إذا أعطاه مالا مقارضة أن لا تجعل مالي في كبد رطبة ولا تحمله في بحر ولا تنزل به في بطن مسيل فإن فعلت شيئا من ذلك فقد ضمنت مالي. رواه الدارقطني ورجاله ثقات. وقال مالك في الموطأ عن العلاء بن عبد الرحمن بن يعقوب عن أبيه عن جده : إنه عمل في مال لعثمان على أن الربح بينهما. وهو موقوف صحيح.
Narrated al-Hakim bin Hazim (RA): He used to make a condition on the man to whom he gave his property in al-Muqaradah (to trade with, and the profit being shared between them), that: "You should not trade with my property in living beings, and do not transport it by sea, and do not settle with it at the bottom of a river-bed; and if you do any of the aforesaid acts you should then guarantee my property." [ad-Daraqutni reported it and its narrators are reliable (thiqah)]. Malik said in al-Muwatta' from al-'Ala bin 'Abdur-Rahman bin Ya'qub from his father on the authority of his grandfather that he traded with some property belonging to 'Uthman (RA) so that the profit would be divided between them. [This hadith is Mawquf (saying of a Companion) Sahih (authentic)].

«حضرت عَلاء رحمہ اللہ » His kunyah is Abu Shibl, and his lineage is as follows: Alaa bin Abdur Rahman bin Yaqub Juhani.
He was a freed slave of the tribe of Harqah.
(In "Harqah," the "Ha" has a dammah and the "Ra" has a fathah.)
He was a resident of Madinah.
He was a great Imam.
He was among the younger Tabi‘in.
He belonged to the fifth generation (Tabaqah Khamisah).
He was truthful (saduq).
At times, he would also make mistakes due to confusion (wahm).
Imam Ahmad rahimahullah and other hadith scholars have declared him trustworthy (thiqah).
Waqidi has said that he passed away during the era of Caliph Mansur.
«حضرت عبدالرحمن بن یعقوب رحمہ اللہ » Abdur Rahman bin Yaqub Juhani Madani.
He was among the average-aged Tabi‘in.
He is counted among the third generation (Tabaqah Thalithah).
He heard hadith not only from his father but also from Abu Hurairah radi Allahu anhu and Abu Sa‘id Khudri radi Allahu anhu.
«حضرت یعقوب رحمہ اللہ » Yaqub Juhani was a freed slave of the tribe of Harqah.
He was among the senior Tabi‘in.
He is counted among the second generation (Tabaqah Thaniyah).
He met Umar radi Allahu anhu and also narrated from him.
Few narrations are reported from him.
