Hadith 758

وعن عروة بن الزبير رضي الله عنهما قال : قال رجل من أصحاب رسول الله صلى الله عليه وآله وسلم : إن رجلين اختصما إلى رسول الله صلى الله عليه وآله وسلم في أرض غرس أحدهما فيها نخلا والأرض للآخر فقضى رسول الله صلى الله عليه وآله وسلم بالأرض لصاحبها وأمر صاحب النخل أن يخرج نخله وقال: « ليس لعرق ظالم حق ». رواه أبو داود وإسناده حسن. وآخره عند أصحاب السنن من رواية عروة عن سعيد بن زيد واختلف في وصله وإرساله وفي تعيين صحابيه.
Narrated 'Urwa bin az-Zubair (RA): A man among the Companions of Allah's Messenger (ﷺ) said: "Two men brought a dispute before Allah's Messenger (ﷺ) concerning a land in which one of them had planted palm trees and the land belonged to the other. So, Allah's Messenger (ﷺ) ruled that the land belongs to its owner, and commanded the owner of the palm trees to uproot his palm trees. He said, "The labor of an unjust person has no right." [Reported by Abu Dawud and its chain of narrators is Hasan (good). The last (quoted) part of the aforesaid Hadith is found in the books of the collections of as-Sunan, from 'Urwa's narration on the authority of Sa'id bin Zaid. However, there is disagreement regarding whether it is Mawsul (an unbroken chain) or Mursal (missing link after the Tabi'i) as well as the determination of the name of the Companion who heard it from the Prophet (ﷺ).

The mentioned narration consists of two parts. Regarding the first part, our esteemed researcher has stated that its chain of narration is weak, whereas other scholars have considered it to be hasan (good), as Hafiz Ibn Hajar rahimahullah, after narrating it, has said that its chain is hasan. Likewise, Shaykh al-Albani rahimahullah has also declared it hasan in Irwa’ al-Ghalil (5/355).

The second portion of the narration, which is from ‘Urwah from Sa‘id ibn Zayd, regarding this the esteemed researcher writes that its origin is in al-Bukhari.

Therefore, despite the first portion of the mentioned narration being weak in its chain, it is still acceptable for practice and as evidence.

«حضرت عروہ بن زبیر» His kunyah is Abu ‘Abdullah.

His lineage is as follows: ‘Urwah ibn Zubayr ibn ‘Awwam ibn Khuwailid al-Asadi al-Madani.

He is counted among the senior Tabi‘in.

He is one of the seven jurists of Madinah al-Munawwarah.

He is a trustworthy and renowned jurist.

He was born at the beginning of the caliphate of ‘Umar radi Allahu anhu, and according to one opinion, he was born in 23 AH.

And according to the correct narration, he passed away in 94 AH.
