وعن عمرو بن شعيب عن أبيه عن جده قال : قال رسول الله صلى الله عليه وآله وسلم : « لا كفالة في حد ». رواه البيهقي بإسناد ضعيف
Narrated 'Amr bin Shu'aib on his father's authority from his grandfather (RA): Allah's Messenger (ﷺ) said: "No surety is allowed regarding a prescribed punishment." [Reported by al-Baihaqi with a Da'if (weak) chain of narrators].

«أخرجه البيهقي:6 /77، وقال : تفرد به بقية عن أبي محمد عمر بن أبي عمر الكلاعي وهو من مشايخ بقية المجهولين ورواياته منكرة.* أبو محمد عمر بن أبي عمر الكلاعي مجهول كما عرفت وبقية عنعن.»©Explanation:
The mentioned narration is weak in its chain of transmission, as our esteemed researcher has also indicated; however, its meaning is correct.
Therefore, only those who commit crimes are deserving of punishment.
The prescribed punishment (hadd) for someone’s crime will not be carried out upon his father, brother, or other relatives.
