Hadith 739

وعن جابر رضي الله تعالى عنه قال : توفي رجل منا فغسلناه وحنطناه وكفناه ثم أتينا به رسول الله صلى الله عليه وآله وسلم فقلنا : تصلي عليه ؟ فخطى خطا ثم قال:« أعليه دين ؟ » قلنا : ديناران فانصرف فتحملهما أبو قتادة فأتيناه فقال أبو قتادة: الديناران علي فقال رسول الله صلى الله عليه وآله وسلم : « حق الغريم وبرىء منهما الميت ؟ » قال : نعم ،‏‏‏‏ فصلى عليه. رواه أحمد وأبو داود والنسائي وصححه ابن حبان والحاكم.
Narrated Jabir (RA): A man from among us died, so we washed, embalmed and shrouded him. We then brought him to Allah's Messenger (ﷺ) and asked him to pray over him. He went forward some steps and then asked, "Does he have any debt against him?" We replied, "Two Dinars." He turned away, but Abu Qatada (RA) took upon himself the bearing of them. We then came to him (again) (ﷺ) and Abu Qatada (RA) said: "I shall discharge the two Dinars." Allah's Messenger (ﷺ) thereupon said, "[Will you be responsible for paying them as] a right to the creditor; and the dead man will then be free from them?" He replied, "Yes." So, he prayed over him. [Reported by Ahmad, Abu Dawud, and an-Nasa'i. Ibn Hibban and al-Hakim graded it Sahih (authentic)].

➊ Guaranteeing the payment of a debt on behalf of the deceased is valid.
➋ The guarantor cannot take the guaranteed amount from the inheritance of the deceased; he must pay the guaranteed sum from his own pocket.
➌ The financial rights of the deceased, which were obligatory upon him—such as Hajj, zakat, repayment of debts, etc.—benefit him, and if someone else fulfills them on his behalf, they are considered fulfilled.
➍ Whether it is a debt or other rights of the servants (‘huquq al-‘ibad’), they are never nullified until they are paid or the rightful owner or creditor himself forgives them; they are not automatically forgiven even after death.
➎ Taking a loan is a very serious and grave matter; one should avoid taking loans as much as possible. If, due to extreme necessity and unavoidable need, one does take a loan, then one should be concerned with repaying it as soon as possible.
