Takhrij:
«أخرجه البزار، كشف الأستار:1 /91، 92.* فيه موسي بن عبيدة وهو ضعيف.»©Explanation:
➊ The aforementioned narration is, by consensus of the scholars, weak, as our esteemed researcher has also declared it weak. Shaykh al-Albani rahimahullah has likewise declared it weak, and while discussing this narration, he has quoted the statement of Imam Ahmad that there is no authentic narration regarding this issue, but there is consensus among the people that selling debt for debt is not permissible. For details, see: (Irwa’ al-Ghalil: 5/220-222, no. 1382). Therefore, the issue mentioned in the narration is correct and sound: that buying and selling debt for debt is prohibited. And Allah knows best.
➋ There are two forms of this:
For example:
* Aslam bought a watch from Ahmad for five hundred rupees on credit for a period of one year. When the year was completed, Aslam says to Ahmad, “I could not arrange the money. Sell it to me anew for six hundred rupees,” i.e., for one hundred rupees extra. In this way, it is as if Aslam has given Ahmad one hundred rupees in exchange for more time.
* Zayd has to take one hundred rupees from Khalid, and Sadiq has to take some cloth from Khalid. So Sadiq says to Zayd, “The cloth that I am to take from Khalid, I sell it to you for one hundred rupees.” This sale is also impermissible.
