Hadith 705

وعن ابن عمر رضي الله عنهما قال : سمعت رسول الله صلى الله عليه وآله وسلم يقول : « إذا تبايعتم بالعينة ،‏‏‏‏ وأخذتم أذناب البقر ،‏‏‏‏ ورضيتم بالزرع ،‏‏‏‏ وتركتم الجهاد ،‏‏‏‏ سلط الله عليكم ذلا لا ينزعه شيء حتى ترجعوا إلى دينكم ». رواه أبو داود من رواية نافع عنه ،‏‏‏‏ وفي إسناده مقال ،‏‏‏‏ ولأحمد نحوه من رواية عطاء ،‏‏‏‏ ورجاله ثقات ،‏‏‏‏ وصححه ابن القطان.
Narrated 'Abdullah bin 'Amr bin al-'Aar (RA): The Prophet (ﷺ) commanded him to equip an army. Then, when the camels were insufficient, he commanded him to keep back the young camels of Sadaqah. He said, "I was taking a camel to be replaced by two when the camels of Sadaqah came." [Reported by al-Hakim and al-Baihaqi; its narrators are reliable].

➊ The aforementioned narration has been declared weak in its chain by our esteemed researcher, whereas Shaykh al-Albani rahimahullah has declared it authentic and has discussed it in detail, from which the opinion of the authenticity of the hadith appears to be correct.
Therefore, despite the aforementioned narration being weak in its chain, it is still actionable and a valid proof.

➋ In this hadith, there is mention of bay‘ ‘inah (a specific type of sale), as well as the information that adopting agriculture and farming and abandoning jihad results in humiliation and disgrace being imposed by Allah Ta‘ala.

➌ One form of bay‘ ‘inah is that a person asks another for something on credit; the other replies, “Brother, I cannot give you this thing on credit, but I have such-and-such item whose price is ten rupees. If you agree, I can sell it to you for fifteen rupees,” and then he himself buys it back from him for ten rupees.
In this way, five rupees become a debt upon the buyer for no reason. Or, for example, someone buys a book for one hundred rupees for a period of one year and promises to pay the hundred rupees after a year, but for some reason, he is unable to arrange the hundred rupees, so the seller buys back the same item from him for ninety rupees. In this way, ten rupees remain as a debt upon him.
Since in this sale one party incurs a loss, it has been declared prohibited.

© Narrator of the Hadith:
«حضرت نافع رحمہ اللہ » Abu ‘Abdullah Nafi‘ ibn Sarjis al-Madani.
He was the freed slave of ‘Abdullah ibn ‘Umar radi Allahu anhuma.
He was trustworthy, reliable, and a well-known jurist.
He is counted among the senior Tabi‘in.
A large portion of the narrations from ‘Abdullah ibn ‘Umar radi Allahu anhuma revolve around him.
‘Abdullah ibn ‘Umar radi Allahu anhuma himself said that Allah Ta‘ala has done us a great favor through Nafi‘.
Imam Malik rahimahullah said, “When I hear that Nafi‘ narrates from Ibn ‘Umar radi Allahu anhuma, then I do not care to hear the hadith from anyone else.”
Imam al-Bukhari rahimahullah said, “The most authentic chain is Malik from Nafi‘ from Ibn ‘Umar.”
A great multitude of Allah’s creation narrated from him.
He passed away in 117 AH or after.

«حضرت عطاء رحمہ اللہ » refers most likely to ‘Ata’ ibn Abu Muslim Mayasirah al-Khurasani, who was the slave of Muhallab ibn Abi Sufrah and whose kunyah was Abu ‘Uthman.
He settled in al-Sham.
He was among the well-known and famous people.
He was trustworthy and a great performer of night prayers, but his memory was weak and he was prone to many errors.
He passed away in 135 AH at the age of 85.

Benefits and Issues:

The form of ‘Bay‘ al-‘Inah’ (with a kasrah under the ‘ayn) is as follows: a person hands over goods to someone at a deferred price, but before receiving the payment, he buys back the same goods from him at a lower price than his selling price, and then collects the higher price.


Undoubtedly, the humiliation and disgrace of the Muslim Ummah are due to these very causes, especially adopting usury (riba) through legal stratagems (hiyal) and abandoning jihad, just as has been mentioned in the statement of the Messenger of Allah (sallallahu alayhi wa sallam). And there is no power nor might except with Allah.
