Hadith 478

وعن جابر رضي الله عنه أن النبي صلى الله عليه وآله وسلم قال : « لا تدفنوا موتاكم بالليل إلا أن تضطروا ». أخرجه ابن ماجه ،‏‏‏‏ وأصله في مسلم ،‏‏‏‏ لكن قال : زجر أن يقبر الرجل بالليل حتى يصلى عليه.
Jabir bin ‘Abdullah (RAA) narrated that the Messenger of Allah (ﷺ) said: "Do not bury your dead during the night unless you have to do so." Related by Ibn Majah. Muslim reported a similar narration, but Jabir said in his narration, ‘The Prophet (ﷺ) disapproved that someone is buried at night, unless the funeral prayer has been offered for him.’

Lexical Explanation:
«لَا تَدْفِنُوا» is from the chapter «ضَرَبَ يَضْرِبُ». "Do not bury."
«زجَرَ» is derived from «زحِر». To rebuke harshly and to prevent.

Benefit: Regarding the times for burial of the deceased, it is narrated from ‘Uqbah ibn ‘Amir radi Allahu anhu that the Messenger of Allah sallallahu alayhi wa sallam used to forbid us from performing prayer and from burying the deceased at three times:
➊ When the sun is rising until it becomes high.
➋ At the exact time of noon (zenith) until the sun declines.
➌ And when the sun is about to set until it has completely set. [صحيح مسلم ، صلاة المسافرين ، باب الاوقات التى نهي عن الصلاة فيها ، حديث : 831]

Also, in the aforementioned narration of Bulugh al-Maram, which is narrated from Jabir radi Allahu anhu, it is mentioned that the Messenger of Allah sallallahu alayhi wa sallam said: “Do not bury your dead at night, except if you are compelled to do so.” And in the narration of Sahih Muslim, it is reported that the Prophet sallallahu alayhi wa sallam rebuked for burying at night, except if the funeral prayer had already been performed.

After gathering all these ahadith, it becomes clear that it is not permissible to bury the dead during these times, except if there is a necessity or extreme need. Furthermore, the prohibition of burial at night may be due to the assumption that fewer people would participate in the funeral prayer. Therefore, if the funeral prayer has been performed during the day, and due to some excuse burial at night becomes necessary, then it is permissible, as it is narrated from Ibn ‘Abbas radi Allahu anhuma that the Prophet sallallahu alayhi wa sallam buried a companion in his grave at night. Also, Imam Bukhari rahimahullah has stated in a suspended (mu‘allaq) form that Abu Bakr radi Allahu anhu was buried at night. [صحيح البخاري ، الجنائز ، باب الدفن بالليل ، قبل الحديث : 1340]

It is narrated in Musannaf Ibn Abi Shaybah that ‘Ali radi Allahu anhu buried Fatimah radi Allahu anha at night. [المصنف لابن ابي شيبة : 31/3 ۔ رقم : 11827 ، 11826 وفتح الباري : 569/3]

Imam Shawkani rahimahullah states that the aforementioned ahadith are proof that burial at night is permissible. Moreover, the majority (jumhur) also hold this view. [نيل الاوطار : 38/3]
