Hadith 1200

وعن عبد الله بن الزبير رضي الله عنهما قال : قضى رسول الله صلى الله عليه وآله وسلم أن الخصمين يقعدان بين يدي الحاكم . رواه أبو داود وصححه الحاكم
Narrated 'Abdullah bin az-Zubair (RA): Allah's Messenger (ﷺ) ruled that the two opposing parties in a dispute should sit in front of the judge. [Reported by Abu Dawud. al-Hakim graded it Sahih (authentic)].

Explanation:
The aforementioned narration is weak in its chain of transmission; however, what is correct is that in the court, both the plaintiff and the defendant should be considered equally deserving of fair treatment. No preferential treatment should be shown to anyone; both should be present face to face so that there remains no room for any kind of doubt or suspicion. And Allah knows best.

But the correct view is that no party should be given superiority or preference in the court.
Both should be present face to face.
This is clear from the actions and statements of the Messenger of Allah (sallallahu alayhi wa sallam).
