وعن ثابت بن الضحاك رضي الله عنه قال : نذر رجل على عهد رسول الله صلى الله عليه وآله وسلم أن ينحر إبلا ببوانة فأتى رسول الله صلى الله عليه وآله وسلم فسأله فقال :« هل كان فيها وثن يعبد ؟ » قال : لا قال : « فهل كان فيها عيد من أعيادهم ؟ » فقال : لا فقال : « أوف بنذرك فإنه لا وفاء لنذر في معصية الله ولا في قطيعة رحم ولا فيما لا يملك ابن آدم » رواه أبو داود والطبراني واللفظ له وهو صحيح الإسناد وله شاهد من حديث كردم عند أحمد.
Narrated Thabit bin ad-Dahhak (RA): that in the time of Allah's Messenger (ﷺ) a man took a vow to slaughter camels at Bawana. So, he came to Allah's Messenger (ﷺ) and asked him (about that). Allah's Messenger (ﷺ) asked, "Did the place contain any idol which was worshiped (during Jahiliyya era)?" He said, "No." He asked "Were any of their (Jahiliyya) festivals observed there?" He said, "No." He then said (to the man), "Fulfill your vow, for there is no fulfillment of a vow to do an act of disobedience to Allah, now to break the ties of relationship, nor to do something over which a human being has no control." [Reported by Abu Dawud and at-Tabarani, and the wording is his (at-Tabarani). It has a sound chain of narrators]. It has a Shahid (supporting narration) from the Hadith of Kardam reported by Ahmad.

Clarification: « حضرت کَرْدم رضی اللہ عنہ » bin Sufyan al-Thaqafi. In “Kardam,” the letter “kaf” has a fatha (a), and the “ra” is sukun (silent). From him, his daughter, Lady Maymunah radi Allahu anha, and Abdullah bin Amr bin al-As radi Allahu anhuma have narrated.

´Narrated Thabit bin Adh-Dahhak:` That the Prophet (ﷺ) said: "It is not for a person to vow about that over which he has no control."

Explanation: 1: That is, when making a vow (nadhar), if the matter is not within the servant’s control, then such a vow is not valid. Even if later he gains control over that matter, the vow will still not be fulfilled, and there is no expiation (kaffarah) upon it either.

The Prophet ﷺ asked: Did the place contain any idol worshipped in pre-Islamic times? They (the people) said: No. He asked: Was any pre-Islamic festival observed there? They replied: No. The Prophet ﷺ said: Fulfil your vow, for a vow to do an act of disobedience to Allah must not be fulfilled, neither must one do something over which a human being has no control.

Benefits and Issues: At such places where the people of disbelief and polytheism, and the people of innovation, perform their specific acts, a Muslim who follows the Sunnah should refrain from worshipping Allah at those locations. Similarly, those specific days and dates in which these people have made their innovations well-known, it is better to avoid performing acts of goodness resembling theirs on those occasions, so that disassociation from them and their innovations may be expressed.
