Hadith 1135

عن أبي هريرة رضي الله عنه عن النبي صلى الله عليه وآله وسلم قال : « كل ذي ناب من السباع فأكله حرام ». رواه مسلم. وأخرجه من حديث ابن عباس رضي الله عنهما بلفظ : " نهى " . وزاد : « وكل ذي مخلب من الطير».
Abu Hurairah (RAA) narrated that the Messenger of Allah (ﷺ) said: "Eating any predatory beast that has fangs, is prohibited." Related by Muslim. Muslim transmitted the same hadith on the authority of Ibn 'Abbas (RAA), 'He (The Messenger of Allah (ﷺ)) prohibited...' and had the additional phrase, 'and every bird with talons.'

In this hadith, a comprehensive sign of the prohibition regarding animals has been stated, and that is: every predatory beast that tears and rends—in other words, every carnivorous animal—is unlawful (haram). And every bird that hunts and eats with its talon is also unlawful.

This principle has been accepted by Imam Shafi‘i, Imam Abu Hanifah, Imam Ahmad, and Dawud Zahiri (rahimahumullah), but despite this, there is a difference of opinion regarding the reality of predatory beasts. Thus, according to Imam Abu Hanifah (rahimahullah), any carnivorous animal, regardless of its type, is considered a sabu‘ (predatory beast).

On this basis, the cat, elephant, etc., are also included among the sabu‘.

According to Imam Shafi‘i (rahimahullah), among predatory beasts, those are unlawful which attack humans, such as the lion, wolf, leopard, etc.

The badger and the fox are not (unlawful), because they do not attack humans.

Similarly, any bird that hunts with its talon and eats with its talon is also unlawful, such as the eagle, hawk, falcon, and saker, etc.

This is the view of the majority of scholars, but Imam Malik (rahimahullah) has declared them to be disliked (makruh), not unlawful (haram); however, he has declared the kite and vulture to be unlawful due to their filthiness.
