Hadith 1077

وعن علي رضي الله عنه قال : " ما كنت لأقيم على أحد حدا فيموت فأجد في نفسي إلا شارب الخمر فإنه لو مات وديته " أخرجه البخاري.
'Ali (RAA) narrated, 'I would not blame myself for the death of a man when I inflicted prescribed punishment on him, with the exception of one who drunk Khamr, for if he were to die, I would pay Diyah for him

➊ The reason why Ali radi Allahu anhu stated that blood money (diyah) is due in the case where a person dies from the punishment for drinking alcohol is that the Messenger of Allah sallallahu alayhi wa sallam did not prescribe a fixed punishment (hadd) for the one who drinks alcohol. Therefore, if a person dies as a result of this punishment, it falls under the category of accidental killing (qatl khata’), and in the case of accidental killing, payment of blood money (diyah) is obligatory.
➋ The majority of scholars (jumhur ulama) also hold the view that if a person dies as a result of discretionary punishment (ta’zir), it is necessary for the head of state to pay his blood money (diyah).
