Hadith 1041

وعن عمران بن حصين رضي الله عنهما أن امرأة من جهينة أتت النبي صلى الله عليه وآله وسلم وهي حبلى من الزنا فقالت : يا نبي الله أصبت حدا فأقمه علي فدعا رسول الله صلى الله عليه وآله وسلم وليها فقال : «أحسن إليها فإذا وضعت فأتني بها » ففعل فأمر بها فشكت عليها ثيابها ثم أمر بها فرجمت ثم صلى عليها فقال عمر : أتصلي عليها يا نبي الله وقد زنت ؟ فقال : « لقد تابت توبة لو قسمت بين سبعين من أهل المدينة لوسعتهم وهل وجدت أفضل من أن جادت بنفسها لله ». رواه مسلم.
'Imran bin Husain (RAA) narrated, 'A woman from Juhainah came to the Prophet (ﷺ) while she was pregnant due to committing adultery and said, 'O Messenger of Allah! I have done something for which a prescribed punishment is to be inflicted, so please inflict it on me. The Messenger of Allah (ﷺ) called her guardian and said, "Be good to her, and when she delivers bring her back to me." Her guardian brought her back when she had delivered and the Messenger of Allah (ﷺ) gave his commands and her clothes were tied around her and then the Prophet (ﷺ) gave his commands and she was stoned to death. The Messenger of Allah (ﷺ) offered funeral prayer for her and thereupon 'Umar said, 'O Messenger of Allah! You offer funeral prayer for her even though she committed adultery?' The Messenger of Allah (ﷺ) replied, "She has offered such a repentance (for her sin) that if it was divided between seventy of the inhabitants of Madinah, it would be sufficient for them. Have you found such repentance better than sacrificing her life for the sake of Allah, the Almighty?" Related by Muslim.

➊ From this hadith, it is understood that the prescribed punishment (hadd) for a pregnant woman who has committed adultery should not be carried out immediately. One should wait until she has delivered the child. Even after childbirth, if someone takes responsibility for the upbringing of the newborn and arrangements are made for a wet nurse, then the hadd will be implemented. If such arrangements cannot be made immediately, then the implementation of the hadd will be postponed until the child is weaned.

➋ The hadith emphasizes treating such a woman with kindness, because ignorant female relatives and foolish men make her life miserable with taunts and reproaches. Apart from the legal punishment, such inappropriate behavior and unjust treatment is tantamount to killing her while she is alive.

➌ From this hadith, it is understood that if a previously married woman (widow, divorcee, or one who has a husband) commits adultery, she too will be stoned. It is also understood that while stoning a woman, her private parts should be covered. For this reason, the scholars of the ummah have ruled that a man should be stoned while standing, and a woman should be made to sit in a pit and then stoned.

➍ The funeral prayer (salat al-janazah) should be performed for both men and women who have been sentenced to stoning.

➎ The position of the majority of scholars is that both the general public and the elite should participate in the funeral prayer, as has been mentioned earlier.
