Hadith 1010

وعن ابن مسعود عن النبي صلى الله عليه وآله وسلم قال : « دية الخطأ أخماسا : عشرون حقة وعشرون جذعة وعشرون بنات مخاض وعشرون بنات لبون وعشرون بني لبون» أخرجه الدارقطني وأخرجه الأربعة بلفظ : « وعشرون بنو مخاض » بدل « لبون » وإسناد الأول أقوى وأخرجه ابن أبي شيبة من وجه آخر موقوفا وهو أصح من المرفوع وأخرجه أبو داود والترمذي من طريق عمرو بن شعيب عن أبيه عن جده رضي الله عنهما رفعه: « الدية ثلاثون حقة وثلاثون جذعة وأربعون خلفة في بطونها أولادها ».
Ibn Mas’ud (RAA) narrated that The Messenger of Allah (ﷺ) said: “The Diyah for accidental killing is paid in five types of camel indemnity: 20 she-camels ‘hiqqah’ (in their fourth year), 20 she-camels ‘Jaz'ah’ (in their fifth year), 20 she-camels ‘bint makhad’ (in their second year), 20 she-camels ‘bint labun’ (in their third year) and 20 he-camels 'ibn labun' (in their third year).”Related by Ad-Daraqutni with a strong chain of narrators. The four Imams reported it with this version, “twenty ‘ibn makhad’ (twenty male camels which had entered their second year),” instead of “ibn labun.” Abu Dawud and At-Tirmidhi transmitted on the authority of 'Amro bin Shu'aib on his father’s authority, who reported from his grandfather (RAA), who reported that the Messenger of Allah (ﷺ) said: “The Diyah (of intentional homicide) is paid in three different types of camels: 30 she-camels ‘hiqqah’ (in their fourth year), 30 she-camels ‘Jaz'ah’ (in their fifth year), and 40 pregnant she-camels.”

Explanation:
1:
There are three types of killing: 1- Intentional killing (qatl ‘amd):
That is, deliberately using such a weapon by which killing generally occurs.
In this case, retribution (qisas) is taken from the killer.
2. Accidental killing (qatl khata’):
That is, killing occurs by mistake.
In the above hadith, the blood money (diyah) for this type of killing is mentioned.
3. Killing resembling intentional (qatl shibh al-‘amd):
This is the type of killing in which such things are used that do not generally cause death, such as a stick or a whip, etc.
In this, aggravated blood money (diyat mughallazah) is taken, and this is one hundred camels, among which forty must be pregnant she-camels.

2:
The wealth that is given in compensation for the killing of a soul or the loss of any limb of the body is called diyah (blood money).

3:
A she-camel that has completed one year of age.

4:
A she-camel that has completed two years of age.

5:
A camel that has completed four years of age.

6:
A camel that has completed three years of age.
