Chapter. The legal regulation concerning AI-Murtad and Al-Murtaddah [male and female who reverts from Islam (apostates)].

Hadith 6922
حَدَّثَنَا أَبُو النُّعْمَانِ مُحَمَّدُ بْنُ الْفَضْلِ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ أَيُّوبَ ، عَنْ عِكْرِمَةَ ، قَالَ : أُتِيَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ بِزَنَادِقَةٍ ، فَأَحْرَقَهُمْ ، فَبَلَغَ ذَلِكَ ابْنَ عَبَّاسٍ ، فَقَالَ : لَوْ كُنْتُ أَنَا لَمْ أُحْرِقْهُمْ ، لِنَهْيِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " لَا تُعَذِّبُوا بِعَذَابِ اللَّهِ ، وَلَقَتَلْتُهُمْ ، لِقَوْلِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ " .
Narrated `Ikrima: Some Zanadiqa (atheists) were brought to `Ali and he burnt them. The news of this event, reached Ibn `Abbas who said, "If I had been in his place, I would not have burnt them, as Allah's Apostle forbade it, saying, 'Do not punish anybody with Allah's punishment (fire).' I would have killed them according to the statement of Allah's Apostle, 'Whoever changed his Islamic religion, then kill him.'"
، وَقَالَ ابْنُ عُمَرَ ، وَالزُّهْرِيُّ ، وَإِبْرَاهِيمُ : تُقْتَلُ الْمُرْتَدَّةُ ، وَقَالَ اللَّهُ تَعَالَى كَيْفَ يَهْدِي اللَّهُ قَوْمًا كَفَرُوا بَعْدَ إِيمَانِهِمْ وَشَهِدُوا أَنَّ الرَّسُولَ حَقٌّ وَجَاءَهُمُ الْبَيِّنَاتُ وَاللَّهُ لا يَهْدِي الْقَوْمَ الظَّالِمِينَ { 86 } أُولَئِكَ جَزَاؤُهُمْ أَنَّ عَلَيْهِمْ لَعْنَةَ اللَّهِ وَالْمَلائِكَةِ وَالنَّاسِ أَجْمَعِينَ { 87 } خَالِدِينَ فِيهَا لا يُخَفَّفُ عَنْهُمُ الْعَذَابُ وَلا هُمْ يُنْظَرُونَ { 88 } إِلا الَّذِينَ تَابُوا مِنْ بَعْدِ ذَلِكَ وَأَصْلَحُوا فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ { 89 } إِنَّ الَّذِينَ كَفَرُوا بَعْدَ إِيمَانِهِمْ ثُمَّ ازْدَادُوا كُفْرًا لَنْ تُقْبَلَ تَوْبَتُهُمْ وَأُولَئِكَ هُمُ الضَّالُّونَ { 90 } سورة آل عمران آية 86-90 ، وَقَالَ : يَأَيُّهَا الَّذِينَ آمَنُوا إِنْ تُطِيعُوا فَرِيقًا مِنَ الَّذِينَ أُوتُوا الْكِتَابَ يَرُدُّوكُمْ بَعْدَ إِيمَانِكُمْ كَافِرِينَ سورة آل عمران آية 100 ، وَقَالَ إِنَّ الَّذِينَ آمَنُوا ثُمَّ كَفَرُوا ثُمَّ آمَنُوا ثُمَّ كَفَرُوا ثُمَّ ازْدَادُوا كُفْرًا لَمْ يَكُنِ اللَّهُ لِيَغْفِرَ لَهُمْ وَلا لِيَهْدِيَهُمْ سَبِيلا سورة النساء آية 137 ، وَقَالَ مَنْ يَرْتَدَّ مِنْكُمْ عَنْ دِينِهِ فَسَوْفَ يَأْتِي اللَّهُ بِقَوْمٍ يُحِبُّهُمْ وَيُحِبُّونَهُ أَذِلَّةٍ عَلَى الْمُؤْمِنِينَ أَعِزَّةٍ عَلَى الْكَافِرِينَ سورة المائدة آية 54 ، وَقَالَ وَلَكِنْ مَنْ شَرَحَ بِالْكُفْرِ صَدْرًا فَعَلَيْهِمْ غَضَبٌ مِنَ اللَّهِ وَلَهُمْ عَذَابٌ عَظِيمٌ { 106 } ذَلِكَ بِأَنَّهُمُ اسْتَحَبُّوا الْحَيَاةَ الدُّنْيَا عَلَى الآخِرَةِ وَأَنَّ اللَّهَ لا يَهْدِي الْقَوْمَ الْكَافِرِينَ { 107 } أُولَئِكَ الَّذِينَ طَبَعَ اللَّهُ عَلَى قُلُوبِهِمْ وَسَمْعِهِمْ وَأَبْصَارِهِمْ وَأُولَئِكَ هُمُ الْغَافِلُونَ { 108 } لا جَرَمَ أَنَّهُمْ فِي الآخِرَةِ هُمُ الْخَاسِرونَ { 109 } سورة النحل آية 106-109 إِلَى لَغَفُورٌ رَحِيمٌ سورة النحل آية 110 وَلا يَزَالُونَ يُقَاتِلُونَكُمْ حَتَّى يَرُدُّوكُمْ عَنْ دِينِكُمْ إِنِ اسْتَطَاعُوا وَمَنْ يَرْتَدِدْ مِنْكُمْ عَنْ دِينِهِ فَيَمُتْ وَهُوَ كَافِرٌ فَأُولَئِكَ حَبِطَتْ أَعْمَالُهُمْ فِي الدُّنْيَا وَالآخِرَةِ وَأُولَئِكَ أَصْحَابُ النَّارِ هُمْ. فِيهَا خَالِدُونَ سورة البقرة آية 217 .
‘And Abdullah bin Umar, Zuhri, and Ibrahim Nakha’i said: A female apostate should be killed. In this chapter, it is also mentioned that repentance should be sought from apostates. And Allah the Exalted has said (in Surah Al-Imran): “How shall Allah guide a people who disbelieved after their belief, and (after) they had borne witness that the Messenger (Muhammad, peace be upon him) is true, and clear proofs had come to them? And Allah does not guide the wrongdoing people. The recompense of such is that upon them is the curse of Allah and the angels and all mankind. They will abide therein (in the curse); their punishment will not be lightened, nor will they be reprieved. Except for those who repent after that and reform, for indeed, Allah is Forgiving, Merciful. Indeed, those who disbelieve after their belief and then increase in disbelief – never will their repentance be accepted, and those are the ones astray.” And He said: “O you who have believed, if you obey a party of those who were given the Scripture, they would turn you back, after your belief, to (being) disbelievers.” And in the twentieth ruku of Surah An-Nisa, He said: “Indeed, those who believed then disbelieved, then believed, then disbelieved, then increased in disbelief – Allah will not forgive them, nor will He guide them to a way.” And in the eighth ruku of Surah Al-Ma’idah, He said: “And whoever of you reverts from his religion (to disbelief) and dies while he is a disbeliever – never will their deeds be accepted in this world or the Hereafter, and those are the companions of the Fire; they will abide therein eternally.” And in the fourteenth ruku of Surah An-Nahl, He said: “But whoever disbelieves after his belief – except for one who is forced (to renounce his religion) while his heart is secure in faith – but those who (willingly) open their breasts to disbelief, upon them is wrath from Allah, and for them is a great punishment. That is because they preferred the worldly life over the Hereafter and because Allah does not guide the disbelieving people. Those are the ones over whose hearts and hearing and vision Allah has set a seal, and it is those who are the heedless. Assuredly, in the Hereafter they will be the losers.” Until the end of the verse «إن ربك من بعدها لغفور رحيم». And in the twenty-seventh ruku of Surah Al-Baqarah, He said: “They will not cease fighting you until they turn you back from your religion if they are able. And whoever of you reverts from his religion and dies while he is a disbeliever – for those, their deeds have become worthless in this world and the Hereafter, and those are the companions of the Fire; they will abide therein eternally.” (Imam Bukhari, may Allah have mercy on him, has here gathered all the verses that have come in the Noble Qur’an regarding apostates.)

، وَقَالَ ابْنُ عُمَرَ ، وَالزُّهْرِيُّ ، وَإِبْرَاهِيمُ : تُقْتَلُ الْمُرْتَدَّةُ ، وَقَالَ اللَّهُ تَعَالَى كَيْفَ يَهْدِي اللَّهُ قَوْمًا كَفَرُوا بَعْدَ إِيمَانِهِمْ وَشَهِدُوا أَنَّ الرَّسُولَ حَقٌّ وَجَاءَهُمُ الْبَيِّنَاتُ وَاللَّهُ لا يَهْدِي الْقَوْمَ الظَّالِمِينَ { 86 } أُولَئِكَ جَزَاؤُهُمْ أَنَّ عَلَيْهِمْ لَعْنَةَ اللَّهِ وَالْمَلائِكَةِ وَالنَّاسِ أَجْمَعِينَ { 87 } خَالِدِينَ فِيهَا لا يُخَفَّفُ عَنْهُمُ الْعَذَابُ وَلا هُمْ يُنْظَرُونَ { 88 } إِلا الَّذِينَ تَابُوا مِنْ بَعْدِ ذَلِكَ وَأَصْلَحُوا فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ { 89 } إِنَّ الَّذِينَ كَفَرُوا بَعْدَ إِيمَانِهِمْ ثُمَّ ازْدَادُوا كُفْرًا لَنْ تُقْبَلَ تَوْبَتُهُمْ وَأُولَئِكَ هُمُ الضَّالُّونَ { 90 } سورة آل عمران آية 86-90 ، وَقَالَ : يَأَيُّهَا الَّذِينَ آمَنُوا إِنْ تُطِيعُوا فَرِيقًا مِنَ الَّذِينَ أُوتُوا الْكِتَابَ يَرُدُّوكُمْ بَعْدَ إِيمَانِكُمْ كَافِرِينَ سورة آل عمران آية 100 ، وَقَالَ إِنَّ الَّذِينَ آمَنُوا ثُمَّ كَفَرُوا ثُمَّ آمَنُوا ثُمَّ كَفَرُوا ثُمَّ ازْدَادُوا كُفْرًا لَمْ يَكُنِ اللَّهُ لِيَغْفِرَ لَهُمْ وَلا لِيَهْدِيَهُمْ سَبِيلا سورة النساء آية 137 ، وَقَالَ مَنْ يَرْتَدَّ مِنْكُمْ عَنْ دِينِهِ فَسَوْفَ يَأْتِي اللَّهُ بِقَوْمٍ يُحِبُّهُمْ وَيُحِبُّونَهُ أَذِلَّةٍ عَلَى الْمُؤْمِنِينَ أَعِزَّةٍ عَلَى الْكَافِرِينَ سورة المائدة آية 54 ، وَقَالَ وَلَكِنْ مَنْ شَرَحَ بِالْكُفْرِ صَدْرًا فَعَلَيْهِمْ غَضَبٌ مِنَ اللَّهِ وَلَهُمْ عَذَابٌ عَظِيمٌ { 106 } ذَلِكَ بِأَنَّهُمُ اسْتَحَبُّوا الْحَيَاةَ الدُّنْيَا عَلَى الآخِرَةِ وَأَنَّ اللَّهَ لا يَهْدِي الْقَوْمَ الْكَافِرِينَ { 107 } أُولَئِكَ الَّذِينَ طَبَعَ اللَّهُ عَلَى قُلُوبِهِمْ وَسَمْعِهِمْ وَأَبْصَارِهِمْ وَأُولَئِكَ هُمُ الْغَافِلُونَ { 108 } لا جَرَمَ أَنَّهُمْ فِي الآخِرَةِ هُمُ الْخَاسِرونَ { 109 } سورة النحل آية 106-109 إِلَى لَغَفُورٌ رَحِيمٌ سورة النحل آية 110 وَلا يَزَالُونَ يُقَاتِلُونَكُمْ حَتَّى يَرُدُّوكُمْ عَنْ دِينِكُمْ إِنِ اسْتَطَاعُوا وَمَنْ يَرْتَدِدْ مِنْكُمْ عَنْ دِينِهِ فَيَمُتْ وَهُوَ كَافِرٌ فَأُولَئِكَ حَبِطَتْ أَعْمَالُهُمْ فِي الدُّنْيَا وَالآخِرَةِ وَأُولَئِكَ أَصْحَابُ النَّارِ هُمْ. فِيهَا خَالِدُونَ سورة البقرة آية 217 .

حَدَّثَنَا مُسَدَّدٌ ، حَدَّثَنَا يَحْيَى ، عَنْ قُرَّةَ بْنِ خَالِدٍ ، حَدَّثَنِي حُمَيْدُ بْنُ هِلَالٍ ، حَدَّثَنَا أَبُو بُرْدَةَ ، عَنْ أَبِي مُوسَى ، قَالَ : " أَقْبَلْتُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَمَعِي رَجُلَانِ مِنَ الْأَشْعَرِيِّينَ ، أَحَدُهُمَا عَنْ يَمِينِي وَالْآخَرُ عَنْ يَسَارِي ، وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَسْتَاكُ ، فَكِلَاهُمَا سَأَلَ الْعَمَلَ ، فَقَالَ : يَا أَبَا مُوسَى ، أَوْ يَا عَبْدَ اللَّهِ بْنَ قَيْسٍ ، قَالَ : قُلْتُ : وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَطْلَعَانِي عَلَى مَا فِي أَنْفُسِهِمَا ، وَمَا شَعَرْتُ أَنَّهُمَا يَطْلُبَانِ الْعَمَلَ ، فَكَأَنِّي أَنْظُرُ إِلَى سِوَاكِهِ تَحْتَ شَفَتِهِ قَلَصَتْ ، فَقَالَ : " لَنْ أَوْ لَا نَسْتَعْمِلُ عَلَى عَمَلِنَا مَنْ أَرَادَهُ ، وَلَكِنِ اذْهَبْ أَنْتَ يَا أَبَا مُوسَى ، أَوْ يَا عَبْدَ اللَّهِ بْنَ قَيْسٍ إِلَى الْيَمَنِ ، ثُمَّ اتَّبَعَهُ مُعَاذُ بْنُ جَبَلٍ ، فَلَمَّا قَدِمَ عَلَيْهِ أَلْقَى لَهُ وِسَادَةً ، قَالَ : انْزِلْ ، وَإِذَا رَجُلٌ عِنْدَهُ مُوثَقٌ ، قَالَ : مَا هَذَا ؟ ، قَالَ : كَانَ يَهُودِيًّا فَأَسْلَمَ ، ثُمَّ تَهَوَّدَ ، قَالَ : اجْلِسْ ، قَالَ : لَا أَجْلِسُ حَتَّى يُقْتَلَ قَضَاءُ اللَّهِ وَرَسُولِهِ ، ثَلَاثَ مَرَّاتٍ ، فَأَمَرَ بِهِ ، فَقُتِلَ ، ثُمَّ تَذَاكَرَا قِيَامَ اللَّيْلِ ، فَقَالَ أَحَدُهُمَا : أَمَّا أَنَا فَأَقُومُ وَأَنَامُ وَأَرْجُو فِي نَوْمَتِي مَا أَرْجُو فِي قَوْمَتِي " .
Narrated Abu Burda: Abu Musa said, "I came to the Prophet along with two men (from the tribe) of Ash`ariyin, one on my right and the other on my left, while Allah's Apostle was brushing his teeth (with a Siwak), and both men asked him for some employment. The Prophet said, 'O Abu Musa (O `Abdullah bin Qais!).' I said, 'By Him Who sent you with the Truth, these two men did not tell me what was in their hearts and I did not feel (realize) that they were seeking employment.' As if I were looking now at his Siwak being drawn to a corner under his lips, and he said, 'We never (or, we do not) appoint for our affairs anyone who seeks to be employed. But O Abu Musa! (or `Abdullah bin Qais!) Go to Yemen.'" The Prophet then sent Mu`adh bin Jabal after him and when Mu`adh reached him, he spread out a cushion for him and requested him to get down (and sit on the cushion). Behold: There was a fettered man beside Abu Muisa. Mu`adh asked, "Who is this (man)?" Abu Muisa said, "He was a Jew and became a Muslim and then reverted back to Judaism." Then Abu Muisa requested Mu`adh to sit down but Mu`adh said, "I will not sit down till he has been killed. This is the judgment of Allah and His Apostle (for such cases) and repeated it thrice. Then Abu Musa ordered that the man be killed, and he was killed. Abu Musa added, "Then we discussed the night prayers and one of us said, 'I pray and sleep, and I hope that Allah will reward me for my sleep as well as for my prayers.'"
