Narrated Abu Huraira: The Prophet said, "There is no Diya for a person injured or killed by an animal (going about without somebody to control it) and similarly, there is no Diya for the one who falls and dies in a well, and also the one who dies in a mine. As regards the Ar-Rikaz (buried wealth), one-fifth thereof is for the state."
And Ibn Sirin narrated that the scholars did not impose compensation for an animal kicking, but if someone injured the animal while turning its reins, then compensation was imposed on the rider. And Hammad said that there is no compensation for kicking, but if someone incites an animal (and because of that the animal kicks someone else), then compensation will be upon the one who incited. Shurayh said that in the case where retaliation has taken place—meaning, first the person hit the animal and then the animal kicked him—there will be no compensation. Hakam said that if a laborer is driving a donkey on which a woman is riding, and then the woman falls, there is no compensation upon the laborer. And Sha'bi said that when someone is driving an animal and then exhausts it, and because of that the animal is harmed, then the driver is liable; but if he is driving it gently from behind in the usual manner, then the driver is not liable.
