بَابُ مِيرَاثِ الأَسِيرِ:

Chapter. The inheritance of a captive (in the hands of the enemy).

Hadith 6763
حَدَّثَنَا أَبُو الْوَلِيدِ ، حَدَّثَنَا شُعْبَةُ ، عَنْ عَدِيٍّ ، عَنْ أَبِي حَازِمٍ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ ، وَمَنْ تَرَكَ كَلًّا فَإِلَيْنَا " .
Narrated Abu Huraira: The Prophet said, " If somebody dies (among the Muslims) leaving some property, the property will go to his heirs; and if he leaves a debt or dependants, we will take care of them."
قَالَ وَكَانَ شُرَيْحٌ يُوَرِّثُ الْأَسِيرَ فِي أَيْدِي الْعَدُوِّ وَيَقُولُ هُوَ أَحْوَجُ إِلَيْهِ ، وَقَالَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ أَجِزْ وَصِيَّةَ الْأَسِيرِ وَعَتَاقَهُ وَمَا صَنَعَ فِي مَالِهِ مَا لَمْ يَتَغَيَّرْ عَنْ دِينِهِ فَإِنَّمَا هُوَ مَالُهُ يَصْنَعُ فِيهِ مَا يَشَاءُ
Imam Bukhari, may Allah have mercy on him, said: Shurayh the judge would allot inheritance to the prisoner and would say that he is even more in need. And ‘Umar ibn ‘Abd al-‘Aziz said that the will of the prisoner, his emancipation (of slaves), and whatever he disposes of in his wealth will be valid as long as he does not apostatize from his religion, because the wealth remains his wealth and he may dispose of it as he wishes.

قَالَ وَكَانَ شُرَيْحٌ يُوَرِّثُ الْأَسِيرَ فِي أَيْدِي الْعَدُوِّ وَيَقُولُ هُوَ أَحْوَجُ إِلَيْهِ ، وَقَالَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ أَجِزْ وَصِيَّةَ الْأَسِيرِ وَعَتَاقَهُ وَمَا صَنَعَ فِي مَالِهِ مَا لَمْ يَتَغَيَّرْ عَنْ دِينِهِ فَإِنَّمَا هُوَ مَالُهُ يَصْنَعُ فِيهِ مَا يَشَاءُ
