بَابُ كَفَّارَاتِ الأَيْمَانِ:

Chapter. The Statement of Allah: “(Then for the) expiation (of a deliberate oath) feed ten Masakin (poor persons)…"

Hadith 6708
حَدَّثَنَا أَحْمَدُ بْنُ يُونُسَ ، حَدَّثَنَا أَبُو شِهَابٍ ، عَنْ ابْنِ عَوْنٍ ، عَنْ مُجَاهِدٍ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى ، عَنْ كَعْبِ بْنِ عُجْرَةَ ، قَالَ : أَتَيْتُهُ : يَعْنِي النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " ادْنُ " ، فَدَنَوْتُ فَقَالَ : " أَيُؤْذِيكَ هَوَامُّكَ ؟ " ، قُلْتُ : نَعَمْ ، قَالَ : " فِدْيَةٌ مِنْ صِيَامٍ ، أَوْ صَدَقَةٍ ، أَوْ نُسُكٍ " ، وَأَخْبَرَنِي ابْنُ عَوْنٍ ، عَنْ أَيُّوبَ ، قَالَ : صِيَامُ ثَلَاثَةِ أَيَّامٍ وَالنُّسُكُ : شَاةٌ وَالْمَسَاكِينُ : سِتَّةٌ .
Narrated Ka`b bin 'Ujra: I came to the Prophet and he said to me, "Come near." So I went near to him and he said, "Are your lice troubling you?" I replied, "Yes." He said, "(Shave your head and) make expiation in the form of fasting, Sadaqa (giving in charity), or offering a sacrifice." (The sub-narrator) Aiyub said, "Fasting should be for three days, and the Nusuk (sacrifice) is to be a sheep, and the Sadaqa is to be given to six poor persons."
وَقَوْلِ اللَّهِ تَعَالَى: {فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ}. وَمَا أَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حِينَ نَزَلَتْ: {فَفِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ} وَيُذْكَرُ عَنِ ابْنِ عَبَّاسٍ وَعَطَاءٍ وَعِكْرِمَةَ مَا كَانَ فِي الْقُرْآنِ أَوْ أَوْ فَصَاحِبُهُ بِالْخِيَارِ وَقَدْ خَيَّرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَعْبًا فِي الْفِدْيَةِ.
And (in Surah Al-Ma'idah) the statement of Allah the Exalted «فكفارته إطعام عشرة مساكين‏» and that when this verse was revealed, the Prophet (peace and blessings of Allah be upon him) ordered that then a ransom must be given, either by fasting, charity, or sacrifice. And it is narrated from Ibn Abbas (may Allah be pleased with them both), and 'Ata and 'Ikrimah, that wherever the word «أو أو» (meaning "or") appears in the Noble Qur'an, it is intended to indicate a choice. And the Prophet (peace and blessings of Allah be upon him) gave Ka'b (may Allah be pleased with him) the choice in the matter of ransom (whether to feed the poor or to offer a goat in charity).
