The Book of Oaths and Vows

بَابُ قَوْلِ اللَّهِ تَعَالَى: {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلاً أُولَئِكَ لاَ خَلاَقَ لَهُمْ فِي الآخِرَةِ وَلاَ يُكَلِّمُهُمُ اللَّهُ وَلاَ يَنْظُرُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ وَلاَ يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ} :

Chapter. The Statement of Allah: “Verily, those who purchase a small gain at the cost of Allah’s Covenant and their oaths..." (V.3:77) And also the Statement of Allah: "And purchase not a small gain at the cost of Allah’s Covenant. Verily! What is with Allah is better for you if you did but know." (V.16:95) And fulfil the Convenant of Allah (Baia: pledge for Islam) when you have convenanted, and break not the oaths after you have confirmed them - and indeed you have appointed Allah your surety..." (V.16:91)

Hadith 6676
حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ ، حَدَّثَنَا أَبُو عَوَانَةَ ، عَنْ الْأَعْمَشِ ، عَنْ أَبِي وَائِلٍ ، عَنْ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ حَلَفَ عَلَى يَمِينِ صَبْرٍ ، يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ ، لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ " ، فَأَنْزَلَ اللَّهُ تَصْدِيقَ ذَلِكَ : إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلا سورة آل عمران آية 77 إِلَى آخِرِ الْآيَةِ .
Narrated `Abdullah: Allah's Apostle said, "If somebody is ordered (by the ruler or the judge) to take an oath, and he takes a false oath in order to grab the property of a Muslim, then he will incur Allah's Wrath when he will meet Him." And Allah revealed in its confirmation: 'Verily! Those who purchase a small gain at the cost of Allah's covenants and their own oaths.' (3.77)
وَقَوْلِهِ جَلَّ ذِكْرُهُ: {وَلاَ تَجْعَلُوا اللَّهَ عُرْضَةً لأَيْمَانِكُمْ أَنْ تَبَرُّوا وَتَتَّقُوا وَتُصْلِحُوا بَيْنَ النَّاسِ وَاللَّهُ سَمِيعٌ عَلِيمٌ}. وَقَوْلِهِ جَلَّ ذِكْرُهُ: {وَلاَ تَشْتَرُوا بِعَهْدِ اللَّهِ ثَمَنًا قَلِيلاً إِنَّ مَا عِنْدَ اللَّهِ هُوَ خَيْرٌ لَكُمْ إِنْ كُنْتُمْ تَعْلَمُونَ}، {وَأَوْفُوا بِعَهْدِ اللَّهِ إِذَا عَاهَدْتُمْ وَلاَ تَنْقُضُوا الأَيْمَانَ بَعْدَ تَوْكِيدِهَا وَقَدْ جَعَلْتُمُ اللَّهَ عَلَيْكُمْ كَفِيلاً}.
And the statement of Allah Almighty «ولا تجعلوا الله عرضة لأيمانكم أن تبروا وتتقوا وتصلحوا بين الناس والله سميع عليم‏»: "And Allah will not speak to them nor look at them on the Day of Resurrection, nor will He purify them, and for them is a painful punishment." And the saying of Allah Almighty (in Surah Al-Baqarah) «ولا تشتروا بعهد الله ثمنا قليلا إن ما عند الله هو خير لكم إن كنتم تعلمون‏»: "And do not make Allah, by your oaths, an obstacle to being righteous and fearing Allah and making peace among people. And Allah is Hearing and Knowing." And (in Surah An-Nahl) He said «وأوفوا بعهد الله إذا عاهدتم ولا تنقضوا الأيمان بعد توكيدها وقد جعلتم الله عليكم كفيلا‏»: "Do not exchange the covenant of Allah for a small price. Indeed, what is with Allah is better for you if you only knew." And in the same context He said: "And fulfill the covenant of Allah when you have taken it, and do not break oaths after their confirmation while you have made Allah, over you, a witness. Indeed, Allah knows what you do."

وَقَوْلِهِ جَلَّ ذِكْرُهُ: {وَلاَ تَجْعَلُوا اللَّهَ عُرْضَةً لأَيْمَانِكُمْ أَنْ تَبَرُّوا وَتَتَّقُوا وَتُصْلِحُوا بَيْنَ النَّاسِ وَاللَّهُ سَمِيعٌ عَلِيمٌ}. وَقَوْلِهِ جَلَّ ذِكْرُهُ: {وَلاَ تَشْتَرُوا بِعَهْدِ اللَّهِ ثَمَنًا قَلِيلاً إِنَّ مَا عِنْدَ اللَّهِ هُوَ خَيْرٌ لَكُمْ إِنْ كُنْتُمْ تَعْلَمُونَ}، {وَأَوْفُوا بِعَهْدِ اللَّهِ إِذَا عَاهَدْتُمْ وَلاَ تَنْقُضُوا الأَيْمَانَ بَعْدَ تَوْكِيدِهَا وَقَدْ جَعَلْتُمُ اللَّهَ عَلَيْكُمْ كَفِيلاً}.

Hadith 6677
فَدَخَلَ الْأَشْعَثُ بْنُ قَيْسٍ ، فَقَالَ : مَا حَدَّثَكُمْ أَبُو عَبْدِ الرَّحْمَنِ ، فَقَالُوا : كَذَا وَكَذَا ، قَالَ : فِيَّ أُنْزِلَتْ ، كَانَتْ لِي بِئْرٌ فِي أَرْضِ ابْنِ عَمٍّ لِي ، فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " بَيِّنَتُكَ أَوْ يَمِينُهُ " ، قُلْتُ : إِذًا يَحْلِفُ عَلَيْهَا يَا رَسُولَ اللَّهِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ حَلَفَ عَلَى يَمِينِ صَبْرٍ وَهُوَ فِيهَا فَاجِرٌ ، يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ ، لَقِيَ اللَّهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ " .
(The sub-narrator added:) Al-Ash'ath bin Qais entered, saying, "What did Abu `Abdur-Rahman narrate to you?" They said, "So-and-so," Al-Ash'ath said, "This verse was revealed in my connection. I had a well on the land of my cousin (and we had a dispute about it). I reported him to Allah 's Apostle who said (to me). "You should give evidence (i.e. witness) otherwise the oath of your opponent will render your claim invalid." I said, "Then he (my opponent) will take the oath, O Allah's Apostle." Allah's Apostle said, "Whoever is ordered (by the ruler or the judge) to give an oath, and he takes a false oath in order to grab the property of a Muslim, then he will incur Allah's Wrath when he meets Him on the Day of Resurrection."
