بَابُ التَّسْمِيَةِ عَلَى الصَّيْدِ:

Chapter. The mentioning of Allah’s Name while hunting.

Hadith 5475
حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا زَكَرِيَّاءُ ، عَنْ عَامِرٍ ، عَنْ عَدِيِّ بْنِ حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : سَأَلْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ صَيْدِ الْمِعْرَاضِ ؟ قَالَ : " مَا أَصَابَ بِحَدِّهِ فَكُلْهُ ، وَمَا أَصَابَ بِعَرْضِهِ فَهُوَ وَقِيذٌ " ، وَسَأَلْتُهُ عَنْ صَيْدِ الْكَلْبِ ؟ فَقَالَ : " مَا أَمْسَكَ عَلَيْكَ فَكُلْ ، فَإِنَّ أَخْذَ الْكَلْبِ ذَكَاةٌ ، وَإِنْ وَجَدْتَ مَعَ كَلْبِكَ أَوْ كِلَابِكَ كَلْبًا غَيْرَهُ فَخَشِيتَ أَنْ يَكُونَ أَخَذَهُ مَعَهُ وَقَدْ قَتَلَهُ ، فَلَا تَأْكُلْ ، فَإِنَّمَا ذَكَرْتَ اسْمَ اللَّهِ عَلَى كَلْبِكَ وَلَمْ تَذْكُرْهُ عَلَى غَيْرِهِ " .
Narrated Adi bin Hatim: I asked the Prophet about the game killed by a Mi'rad (i.e. a sharp-edged piece of wood or a piece of wood provided with a sharp piece of iron used for hunting). He said, "If the game is killed with its sharp edge, eat of it, but if it is killed with its shaft, with a hit by its broad side then the game is (unlawful to eat) for it has been beaten to death." I asked him about the game killed by a trained hound. He said, "If the hound catches the game for you, eat of it, for killing the game by the hound, is like its slaughtering. But if you see with your hound or hounds another dog, and you are afraid that it might have shared in hunting the game with your hound and killed it, then you should not eat of it, because you have mentioned Allah's name on (sending) your hound only, but you have not mentioned it on some other hound.
وَقَوْلِهِ تَعَالَى: {يَا أَيُّهَا الَّذِينَ آمَنُوا لَيَبْلُوَنَّكُمُ اللَّهُ بِشَيْءٍ مِنَ الصَّيْدِ} إِلَى قَوْلِهِ: {عَذَابٌ أَلِيمٌ}. وَقَوْلِهِ جَلَّ ذِكْرُهُ: {أُحِلَّتْ لَكُمْ بَهِيمَةُ الأَنْعَامِ إِلاَّ مَا يُتْلَى عَلَيْكُمْ} إِلَى قَوْلِهِ: {فَلاَ تَخْشَوْهُمْ وَاخْشَوْنِ} وَقَالَ ابْنُ عَبَّاسٍ: الْعُقُودُ الْعُهُودُ، مَا أُحِلَّ وَحُرِّمَ {إِلاَّ مَا يُتْلَى عَلَيْكُمْ} الْخِنْزِيرُ . {يَجْرِمَنَّكُمْ} يَحْمِلَنَّكُمْ {شَنَآنُ} عَدَاوَةُ {الْمُنْخَنِقَةُ} تُخْنَقُ فَتَمُوتُ {الْمَوْقُوذَةُ} تُضْرَبُ بِالْخَشَبِ يُوقِذُهَا فَتَمُوتُ {وَالْمُتَرَدِّيَةُ} تَتَرَدَّى مِنَ الْجَبَلِ {وَالنَّطِيحَةُ} تُنْطَحُ الشَّاةُ، فَمَا أَدْرَكْتَهُ يَتَحَرَّكُ بِذَنَبِهِ أَوْ بِعَيْنِهِ فَاذْبَحْ وَكُلْ.
And the statement of Allah, "So do not fear the disbelievers who object, but fear Me." And the statement of Allah in the same Surah Al-Ma'idah, "O you who believe! Allah will surely test you with something of the game which your hands and your lances can reach..." (the verse). And the statement of Allah in the same Surah Al-Ma'idah, "Lawful to you are the cattle of the livestock except for that which is recited to you (the dead, the swine, etc.)." And the statement of Allah, "So do not fear them (the disbelievers), but fear Me alone." And Ibn Abbas (may Allah be pleased with them both) said: «العقود» refers to the covenants regarding what is lawful and unlawful. «إلا ما يتلى عليكم‏» refers to swine, carrion, blood, etc. «يجرمنكم‏» means to become a cause. «شنآن‏» means enmity and hostility. «المنخنقة‏» is the animal that is strangled to death and dies from it. «الموقوذة‏» is the one that is killed by being struck with wood or stone and dies from it. «المتردية‏» is the one that falls from a mountain and dies. «النطيحة‏» is the one that is gored by another animal. So if you find it moving its tail or rolling its eyes, then slaughter it and eat it, for this is proof of its being alive.
