The Book of Divorce

بَابُ: {وَاللاَّئِي يَئِسْنَ مِنَ الْمَحِيضِ مِنْ نِسَائِكُمْ إِنِ ارْتَبْتُمْ} :

Chapter. “And those of your women as have passed the age of monthly courses, for them the Iddah (prescribed period), if you have doubt, (about their periods)...” (V.65:4)

حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ ، حَدَّثَنَا اللَّيْثُ ، عَنْ جَعْفَرِ بْنِ رَبِيعَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ هُرْمُزَ الْأَعْرَجِ ، قَالَ : أَخْبَرَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ ، أَنَّ زَيْنَبَ بِنْتَ أَبِي سَلَمَةَ أَخْبَرَتْهُ ، عَنْ أُمِّهَا أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّ امْرَأَةً مِنْ أَسْلَمَ يُقَالُ لَهَا : سُبَيْعَةُ كَانَتْ تَحْتَ زَوْجِهَا تُوُفِّيَ عَنْهَا وَهِيَ حُبْلَى ، فَخَطَبَهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ ، فَأَبَتْ أَنْ تَنْكِحَهُ ، فَقَالَ : وَاللَّهِ مَا يَصْلُحُ أَنْ تَنْكِحِيهِ حَتَّى تَعْتَدِّي آخِرَ الْأَجَلَيْنِ ، فَمَكُثَتْ قَرِيبًا مِنْ عَشْرِ لَيَالٍ ، ثُمَّ جَاءَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : انْكِحِي " .
Narrated Um Salama: (the wife of the Prophet) A lady from Bani Aslam, called Subai'a, become a widow while she was pregnant. Abu As-Sanabil bin Ba'kak demanded her hand in marriage, but she refused to marry him and said, "By Allah, I cannot marry him unless I have completed one of the two prescribed periods." About ten days later (after having delivered her child), she went to the Prophet and he said (to her), "You can marry now."
قَالَ مُجَاهِدٌ : إِنْ لَمْ تَعْلَمُوا يَحِضْنَ أَوْ لَا يَحِضْنَ ، وَاللَّائِي قَعَدْنَ عَنِ الْمَحِيضِ ، وَاللَّائِي لَمْ يَحِضْنَ سورة الطلاق آية 4 فَعِدَّتُهُنَّ ثَلاثَةُ أَشْهُرٍ سورة الطلاق آية 4 .
That is, “And those of your women who have despaired of menstruation, if you doubt...” In the explanation, Mujahid said: That is, those women whose condition you do not know, whether they menstruate or not. Likewise, those women who have despaired of menstruation due to old age. Likewise, those women who have not yet begun menstruating due to being underage. The waiting period (‘iddah) for all such types of women is three months.
