Narrated Anas bin Malik: Allah's Apostle said, "Shall I tell you of the best families among the Ansar?" They (the people) said, "Yes, O Allah's Apostle!" The Prophet said, "The best are Banu- An-Najjar, and after them are Banu `Abdil Ash-hal, and after them are Banu Al-Harith bin Al-Khazraj, and after them are Banu Sa`ida." The Prophet then moved his hand by closing his fingers and then opening them like one throwing something, and then said, "Anyhow, there is good in all the families of the Ansar. "
And Allah the Exalted has said (in Surah An-Nur) «والذين يرمون أزواجهم ولم يكن لهم شهداء إلا أنفسهم» "And those who accuse their wives [of adultery] and have no witnesses except themselves..." up to the end of the verse «من الصادقين». If a mute person accuses his wife by writing, by gesture, or by a specific sign, then its status will be like that of one who speaks, because the Prophet (peace and blessings of Allah be upon him) permitted gesture in obligatory acts, and this is also the fatwa of some people of Hijaz and some other scholars. And Allah the Exalted has said «فأشارت إليه قالوا كيف نكلم من كان في المهد صبيا» "And (Maryam [Mary], peace be upon her) pointed to him (Isa [Jesus], peace be upon him), so they said: 'How can we speak to one who is a child in the cradle?'" And Dahhak said that «إلا رمزا» means «إشارة.». Some people have said that (by «إشارة.») neither hadd (legal punishment) nor li'an (mutual cursing) can be established, while they accept that divorce can occur through writing, gesture, and indication. Although they accept divorce and accusation only through speech, it should be said to them that then the same should apply in the case of divorce, and it should only be considered valid through speech; otherwise, if divorce and accusation (are done by gesture), then all should be considered invalid, and the same will apply to the emancipation (of a slave) by gesture, and the same situation will arise with a mute person performing li'an. And Sha'bi and Qatadah have stated that when a person says to his wife, "You are divorced," and gestures with his fingers, then she becomes irrevocably divorced. Ibrahim said that if a mute person writes divorce with his hand, it takes effect. Hammad said that if the mute and deaf gesture with their heads, it is permissible.
