كتاب الطلاقThe Book of Divorce
بَابُ الشِّقَاقِ وَهَلْ يُشِيرُ بِالْخُلْعِ عِنْدَ الضَّرُورَةِ:
Chapter. Ash-Shiqaq (the breach between the man and his wife).
Hadith 5277
حَدَّثَنَا سُلَيْمَانُ ، حَدَّثَنَا حَمَّادٌ ، عَنْ أَيُّوبَ ، عَنْ عِكْرِمَةَ ، أَنَّ جَمِيلَةَ ، فَذَكَرَ الْحَدِيثَ .
Narrated `Ikrima: that Jamila... Then he related the whole ,Hadith, (i.e. 199).
وَقَوْلِهِ تَعَالَى : وَإِنْ خِفْتُمْ شِقَاقَ بَيْنِهِمَا فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا إِلَى قَوْلِهِ : خَبِيرًا سورة النساء آية 35 .
And Allah has said (in Surah An-Nisa) «وإن خفتم شقاق بينهما فابعثوا حكما من أهله وحكما من أهلها» "If you fear dissension between the two (husband and wife), appoint an arbitrator from his people and an arbitrator from her people." (to the end of the verse).
Hadith 5278
حَدَّثَنَا أَبُو الْوَلِيدِ ، حَدَّثَنَا اللَّيْثُ ، عَنْ ابْنِ أَبِي مُلَيْكَةَ ، عَنْ الْمِسْوَرِ بْنِ مَخْرَمَةَ الزُّهْرِيِّ ، قَالَ : سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " إِنَّ بَنِي الْمُغِيرَةِ اسْتَأْذَنُوا فِي أَنْ يَنْكِحَ عَلِيٌّ ابْنَتَهُمْ ، فَلَا آذَنُ " .
Narrated Al-Miswar bin Makhrama Az-Zuhri: I heard the Prophet saying, "Banu Al-Mughira have asked my leave to let `Ali marry their daughter, but I give no leave to this effect."
