بَابُ إِذَا كَانَ الْوَلِيُّ هُوَ الْخَاطِبَ:

Chapter. If the guardian himself is the suitor (of the lady in his charge) (can he marry her to himself or should another guardian marry her to him)?

Hadith 5131
حَدَّثَنَا ابْنُ سَلَامٍ ، أَخْبَرَنَا أَبُو مُعَاوِيَةَ ، حَدَّثَنَا هِشَامٌ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، فِي قَوْلِهِ : " وَيَسْتَفْتُونَكَ فِي النِّسَاءِ قُلِ اللَّهُ يُفْتِيكُمْ فِيهِنَّ سورة النساء آية 127 إِلَى آخِرِ الْآيَةِ ، قَالَتْ : هِيَ الْيَتِيمَةُ تَكُونُ فِي حَجْرِ الرَّجُلِ قَدْ شَرِكَتْهُ فِي مَالِه فَيَرْغَبُ عَنْهَا أَنْ يَتَزَوَّجَهَا وَيَكْرَهُ أَنْ يُزَوِّجَهَا غَيْرَهُ ، فَيَدْخُلَ عَلَيْهِ فِي مَالِهِ ، فَيَحْبِسُهَا ، فَنَهَاهُمُ اللَّهُ عَنْ ذَلِكَ " .
Narrated `Aisha: (regarding His Statement): 'They ask your instruction concerning the women. Say: Allah instructs you about them ...' (4.127) It is about the female orphan who is under the guardianship of a man with whom she shares her property and he does not want to marry her and dislikes that someone else should marry her, lest he should share the property with him, so he prevents her from marrying. So Allah forbade such a guardian to do so (i.e. to prevent her from marrying).
وَخَطَبَ الْمُغِيرَةُ بْنُ شُعْبَةَ امْرَأَةً هُوَ أَوْلَى النَّاسِ بِهَا ، فَأَمَرَ رَجُلًا فَزَوَّجَهُ. وَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ لِأُمِّ حَكِيمٍ بِنْتِ قَارِظٍ : أَتَجْعَلِينَ أَمْرَكِ إِلَيَّ ؟ قَالَتْ : نَعَمْ ، فَقَالَ : قَدْ زَوَّجْتُكِ ، وَقَالَ عَطَاءٌ : لِيُشْهِدْ أَنِّي قَدْ نَكَحْتُكِ أَوْ لِيَأْمُرْ رَجُلًا مِنْ عَشِيرَتِهَا ، وَقَالَ سَهْلٌ : قَالَتِ امْرَأَةٌ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَهَبُ لَكَ نَفْسِي ، فَقَالَ رَجُلٌ : يَا رَسُولَ اللَّهِ إِنْ لَمْ تَكُنْ لَكَ بِهَا حَاجَةٌ فَزَوِّجْنِيهَا .
And Mughirah bin Shu’bah proposed marriage to a woman, and her closest relatives were only those. Eventually, they said to another man (Uthman bin Abi Al-‘As), and he performed their marriage contract. And ‘Abdur-Rahman bin ‘Awf said to Umm Hakim bint Qariz, “You have given me authority regarding your marriage; I may marry you to whomever I wish.” She said, “Yes.” ‘Abdur-Rahman said, “Then I have married you to myself.” And ‘Ata bin Abi Rabah said, “Say to the woman in the presence of two witnesses, ‘I have married you,’ or appoint someone from among the woman’s family (even if they are distant relatives) to perform her marriage contract.” And Sahl bin Sa’d As-Sa’idi narrated that a woman said to the Prophet (ﷺ), “I offer myself to you (in marriage).” Then a man said, “O Messenger of Allah! If you have no need of her, then marry her to me.”

حَدَّثَنَا أَحْمَدُ بْنُ الْمِقْدَامِ ، حَدَّثَنَا فُضَيْلُ بْنُ سُلَيْمَانَ ، حَدَّثَنَا أَبُو حَازِمٍ ، حَدَّثَنَا سَهْلُ بْنُ سَعْدٍ ، " كُنَّا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ جُلُوسًا فَجَاءَتْهُ امْرَأَةٌ تَعْرِضُ نَفْسَهَا عَلَيْهِ فَخَفَّضَ فِيهَا النَّظَرَ وَرَفَعَهُ ، فَلَمْ يُرِدْهَا ، فَقَالَ رَجُلٌ مِنْ أَصْحَابِهِ : زَوِّجْنِيهَا يَا رَسُولَ اللَّهِ ، قَالَ : أَعِنْدَكَ مِنْ شَيْءٍ ؟ قَالَ : مَا عِنْدِي مِنْ شَيْءٍ . قَالَ : وَلَا خَاتَمٌ مِنْ حَدِيدٍ ؟ قَالَ : وَلَا خَاتَمٌ مِنْ حَدِيدٍ ، وَلَكِنْ أَشُقُّ بُرْدَتِي هَذِهِ فَأُعْطِيهَا النِّصْفَ ، وَآخُذُ النِّصْفَ ، قَالَ : لَا ، هَلْ مَعَكَ مِنَ الْقُرْآنِ شَيْءٌ ؟ قَالَ : نَعَمْ ، قَالَ : اذْهَبْ فَقَدْ زَوَّجْتُكَهَا بِمَا مَعَكَ مِنَ الْقُرْآنِ " .
Narrated Sahl bin Sa`d: While we were sitting in the company of the Prophet a woman came to him and presented herself (for marriage) to him. The Prophet looked at her, lowering his eyes and raising them, but did not give a reply. One of his companions said, "Marry her to me O Allah's Apostle!" The Prophet asked (him), "Have you got anything?" He said, "I have got nothing." The Prophet said, "Not even an iron ring?" He Sa`d, "Not even an iron ring, but I will tear my garment into two halves and give her one half and keep the other half." The Prophet; said, "No. Do you know some of the Qur'an (by heart)?" He said, "Yes." The Prophet said, "Go, I have agreed to marry her to you with what you know of the Qur'an (as her Mahr)." 'And for those who have no courses (i.e. they are still immature). (65.4) And the 'Iddat for the girl before puberty is three months (in the above Verse).
