The Book of The Obligations of Khumus

بَابُ وَمِنَ الدَّلِيلِ عَلَى أَنَّ الْخُمُسَ لِلإِمَامِ وَأَنَّهُ يُعْطِي بَعْضَ قَرَابَتِهِ دُونَ بَعْضٍ مَا قَسَمَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِبَنِي الْمُطَّلِبِ وَبَنِي هَاشِمٍ مِنْ خُمُسِ خَيْبَرَ:

Chapter. The proof of the fact that Khumus is for the lmam (i.e., ruler), and taht he has the right to give thereof to some of his relatives to exclusion of others. Whatr the Prophet (p.b.u.h) distributed to Bani Al-Muttalib and Bani Hashim from the Khumus of the Khaibar booty.

Hadith 3140
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، حَدَّثَنَا اللَّيْثُ ، عَنْ عُقَيْلٍ ، عَنْ ابْنِ شِهَابٍ ، عَنْ ابْنِ الْمُسَيَّبِ ، عَنْ جُبَيْرِ بْنِ مُطْعِمٍ ، قَالَ : مَشَيْتُ أَنَا وَعُثْمَانُ بْنُ عَفَّانَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقُلْنَا : يَا رَسُولَ اللَّهِ ، أَعْطَيْتَ بَنِي الْمُطَّلِبِ وَتَرَكْتَنَا وَنَحْنُ وَهُمْ مِنْكَ بِمَنْزِلَةٍ وَاحِدَةٍ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّمَا بَنُو الْمُطَّلِبِ وَبَنُو هَاشِمٍ شَيْءٌ وَاحِدٌ ، قَالَ اللَّيْثُ : حَدَّثَنِي يُونُسُ وَزَادَ ، قَالَ جُبَيْرٌ : وَلَمْ يَقْسِمْ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِبَنِي عَبْدِ شَمْسٍ وَلَا لِبَنِي نَوْفَلٍ ، وَقَالَ ابْنُ إِسْحَاقَ : عَبْدُ شَمْسٍ وَهَاشِمٌ وَالْمُطَّلِبُ إِخْوَةٌ لِأُمٍّ وَأُمُّهُمْ عَاتِكَةُ بِنْتُ مُرَّةَ وَكَانَ نَوْفَلٌ أَخَاهُمْ لِأَبِيهِمْ " .
Narrated Jubair bin Mut`im: I and `Uthman bin `Affan went to Allah's Apostle and said, "O Allah's Apostle! You have given to Bani Al-Muttalib and left us although they and we are of the same kinship to you." Allah's Apostle said, "Bani Muttalib and Bani Hashim are one and the same." The Prophet did not give a share to Bani `Abd Shams and Bani Naufai. (Ibn 'Is-haq said, "Abd Shams and Hashim and Al-Muttalib were maternal brothers and their mother was 'Atika bint Murra and Naufal was their paternal brother.)
قَالَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ : " لَمْ يَعُمَّهُمْ بِذَلِكَ وَلَمْ يَخُصَّ قَرِيبًا دُونَ مَنْ هُوَ أَحْوَجُ إِلَيْهِ ، وَإِنْ كَانَ الَّذِي أَعْطَى لِمَا يَشْكُو إِلَيْهِ مِنَ الْحَاجَةِ ، وَلِمَا مَسَّتْهُمْ فِي جَنْبِهِ مِنْ قَوْمِهِمْ وَحُلَفَائِهِمْ " .
Umar bin Abdul Aziz, may Allah have mercy on him, said that the Prophet Muhammad (peace be upon him) did not give to all relatives, nor did he consider only giving to those who were closer in kinship. Rather, he would give to those who were more in need, even if they were distant relatives. Although those whom he gave would complain to him about their poverty, and also seeing that the loss they suffered from their own people and those of their own kind due to the Prophet’s partiality and preference towards others (was significant).
