بَابُ أَهْلِ الدَّارِ يُبَيَّتُونَ فَيُصَابُ الْوِلْدَانُ وَالذَّرَارِيُّ:
Chapter. (Is it permissible) to attack the enemies wilth the probability of killing the babies and children (unintentionally)?
Hadith 3012
حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا سُفْيَانُ ، حَدَّثَنَا الزُّهْرِيُّ ، عَنْ عُبَيْدِ اللَّهِ ، عَنْ ابْنِ عَبَّاسٍ ، عَنْ الصَّعْبِ بْنِ جَثَّامَةَ رَضِيَ اللَّهُ عَنْهُمْ ، قَالَ : مَرَّ بِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالْأَبْوَاءِ أَوْ بِوَدَّانَ وَسُئِلَ عَنْ أَهْلِ الدَّارِ يُبَيَّتُونَ مِنَ الْمُشْرِكِينَ فَيُصَابُ مِنْ نِسَائِهِمْ وَذَرَارِيِّهِمْ ، قَالَ : هُمْ مِنْهُمْ وَسَمِعْتُهُ ، يَقُولُ : لَا حِمَى إِلَّا لِلَّهِ وَلِرَسُولِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " .
Narrated As-Sab bin Jaththama: The Prophet passed by me at a place called Al-Abwa or Waddan, and was asked whether it was permissible to attack the pagan warriors at night with the probability of exposing their women and children to danger. The Prophet replied, "They (i.e. women and children) are from them (i.e. pagans)." I also heard the Prophet saying, "The institution of Hima is invalid except for Allah and His Apostle."
{بَيَاتًا} لَيْلاً {لَنُبَيِّتَنَّهُ} لَيْلاً، يُبَيِّتُ لَيْلاً.
The word «بياتا» appears in Surah Al-A'raf of the Noble Qur'an, the word «لنبيتنه» in Surah An-Naml, and the word «يبيت» in Surah An-Nisa. All these words have the same root as «يبيتون», and by all of them is meant the time of night.
Hadith 3012

Hadith 3013
وَعَنْ الزُّهْرِيِّ أَنَّه سمِعَ عُبَيْدَ اللَّهِ ، عَنْ ابْنِ عَبَّاسٍ ، حَدَّثَنَا الصَّعْبُ فِي الذَّرَارِيِّ كَانَ عَمْرٌو يُحَدِّثُنَا عَنْ ابْنِ شِهَابٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَسَمِعْنَاهُ مِنَ الزُّهْرِيِّ ، قَالَ : أَخْبَرَنِي عُبَيْدُ اللَّهِ ، عَنْ ابْنِ عَبَّاسٍ ، عَنْ الصَّعْبِ ، قَالَ : " هُمْ مِنْهُمْ وَلَمْ يَقُلْ كَمَا ، قَالَ : عَمْرٌو هُمْ مِنْ آبَائِهِمْ " .
