بَابُ مَا يَجُوزُ مِنَ الاِشْتِرَاطِ وَالثُّنْيَا فِي الإِقْرَارِ:

Chapter. What kinds of conditions are permissible; and what is exempted from the decision.

Hadith 2736
حَدَّثَنَا أَبُو الْيَمَانِ ، أَخْبَرَنَا شُعَيْبٌ ، حَدَّثَنَا أَبُو الزِّنَادِ ، عَنِ الْأَعْرَجِ ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِنَّ لِلَّهِ تِسْعَةً وَتِسْعِينَ اسْمًا مِائَةً إِلَّا وَاحِدًا مَنْ أَحْصَاهَا دَخَلَ الْجَنَّةَ " .
Narrated Abu Huraira: Allah's Apostle said, "Allah has ninety-nine names, i.e. one-hundred minus one, and whoever knows them will go to Paradise." (Please see Hadith No. 419 Vol. 8)
وَالشُّرُوطِ الَّتِي يَتَعَارَفُهَا النَّاسُ بَيْنَهُمْ وَإِذَا قَالَ مِائَةٌ إِلَّا وَاحِدَةً أَوْ ثِنْتَيْنِ وَقَالَ ابْنُ عَوْنٍ : عَنْ ابْنِ سِيرِينَ ، قَالَ رَجُلٌ لِكَرِيِّهِ : " أَرْحِلْ رِكَابَكَ ، فَإِنْ لَمْ أَرْحَلْ مَعَكَ يَوْمَ كَذَا وَكَذَا فَلَكَ مِائَةُ دِرْهَمٍ ، فَلَمْ يَخْرُجْ ، فَقَالَ شُرَيْحٌ : مَنْ شَرَطَ عَلَى نَفْسِهِ طَائِعًا غَيْرَ مُكْرَهٍ فَهُوَ عَلَيْهِ. وَقَالَ أَيُّوبُ : عَنْ ابْنِ سِيرِينَ ، إِنَّ رَجُلًا بَاعَ طَعَامًا ، وَقَالَ : إِنْ لَمْ آتِكَ الْأَرْبِعَاءَ فَلَيْسَ بَيْنِي وَبَيْنَكَ بَيْعٌ ، فَلَمْ يَجِئْ ، فَقَالَ شُرَيْحٌ لِلْمُشْتَرِي : أَنْتَ أَخْلَفْتَ ، فَقَضَى عَلَيْهِ " .
The transactions that are commonly practiced among people, and if someone says, "I owe so-and-so one hundred dirhams, except one or two," and Ibn ‘Awn narrated from Ibn Sirin that someone said to a camel owner, "Bring your camel inside and tie it up. If I am not able to go with you by such-and-such day, then you may collect one hundred dirhams from me." Then, when he was not able to go by that day, Judge Shurayh, may Allah have mercy on him, said: "Whoever imposes a condition upon himself willingly, and was not compelled to do so, then he must fulfill that condition." Ayyub narrated from Ibn Sirin, may Allah have mercy on him, that a man sold grain, and the buyer said, "If I do not come to you by Wednesday, then the sale between you and me will not remain." Then, when he did not come by that day, Shurayh, may Allah have mercy on him, said to the buyer, "You have broken your promise," and he ruled against him.
