The Book of Witnesses

بَابُ مَنْ أَقَامَ الْبَيِّنَةَ بَعْدَ الْيَمِينِ:

Chapter. Whoever produces the proof after (the defendant) has taken the oath.

Hadith 2680
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ ، عَنْ مَالِكٍ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ زَيْنَبَ ، عَنْ أُمِّ سَلَمَةَ رَضِيَ اللَّهُ عَنْهَا ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ وَلَعَلَّ بَعْضَكُمْ أَلْحَنُ بِحُجَّتِهِ مِنْ بَعْضٍ ، فَمَنْ قَضَيْتُ لَهُ بِحَقِّ أَخِيهِ شَيْئًا بِقَوْلِهِ فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ ، فَلَا يَأْخُذْهَا " .
Narrated Um Salama: Once Allah's Apostle said, "You people present your cases to me and some of you may be more eloquent and persuasive in presenting their argument. So, if I give some one's right to another (wrongly) because of the latter's (tricky) presentation of the case, I am really giving him a piece of fire; so he should not take it."
وَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : لَعَلَّ بَعْضَكُمْ أَلْحَنُ بِحُجَّتِهِ مِنْ بَعْضٍ ، وَقَالَ طَاوُسٌ ، وَإِبْرَاهِيمُ ، وَشُرَيْحٌ : الْبَيِّنَةُ الْعَادِلَةُ أَحَقُّ مِنَ الْيَمِينِ الْفَاجِرَةِ .
And the Prophet (peace and blessings of Allah be upon him) said: "It is possible that (between the plaintiff and the defendant) one may present his case better than the other." Tawus, Ibrahim, and Shurayh (may Allah have mercy on them) said that a just witness is more deserving to be accepted than a false oath.
