Narrated `Urwa bin Az-Zubair: A woman committed theft in the Ghazwa of the Conquest (of Mecca) and she was taken to the Prophet who ordered her hand to be cut off. `Aisha said, "Her repentance was perfect and she was married (later) and used to come to me (after that) and I would present her needs to Allah's Apostle."
And Allah the Exalted said (in Surah An-Nur) «ولا تقبلوا لهم شهادة أبدا وأولئك هم الفاسقون * إلا الذين تابوا» "Never accept the testimony of such slanderers, they are indeed the wicked, except those who repent." So Umar (may Allah be pleased with him) administered the hadd punishment to Abu Bakrah, Shibl bin Ma'bad (his maternal brother), and Nafi' bin Harith for slandering Mughira. Then he made them repent and said, "Whoever repents, his testimony will be accepted." And Abdullah bin Utbah, Umar bin Abdul Aziz, Sa'id bin Jubair, Tawus, Mujahid, Sha'bi, Ikrimah, Zuhri, Muharib bin Dithar, Shurayh, and Mu'awiyah bin Qurrah also considered the testimony valid after repentance. And Abu Al-Zinad said, "According to us in Madinah Tayyibah, the ruling is that when «قاذف» retracts his statement and seeks forgiveness, his testimony will be accepted." And Sha'bi and Qatadah said, "When he denies himself and the hadd is carried out on him, his testimony will be accepted." And Sufyan Thawri said, "When a slave is given the hadd of qadhf and then is freed, his testimony will be accepted." And if someone who has received the hadd of qadhf is appointed as a judge, his judgment will be valid. And some people (Imam Abu Hanifah, may Allah have mercy on him) say, "The testimony of the slanderer will not be accepted even if he repents." Then they also say that a marriage is not valid without two witnesses, but if the marriage is conducted with the testimony of witnesses who have received the hadd of qadhf, the marriage will be valid. If it is conducted with the testimony of two slaves, it will not be valid. And these same people have considered the testimony of those who have received the hadd of qadhf and of slave women and men valid for the sighting of the Ramadan moon. And in this chapter, it is mentioned how the repentance of «قاذف» will be known. And the Prophet (peace and blessings be upon him) exiled the adulterer for one year, and the Prophet (peace and blessings be upon him) forbade anyone from speaking to Ka'b bin Malik (may Allah be pleased with him) and his two companions. Fifty nights passed in this manner.
