بَابُ الْهِبَةِ لِلْوَلَدِ:

Chapter. Giving gifts to one’s sons.

Hadith 2586
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنِ ابْنِ شِهَابٍ ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ ، وَمُحَمَّدِ بْنِ النُّعْمَانِ بْنِ بَشِيرٍ ، أنهما حدثاه ، عَنْ النُّعْمَانِ بْنِ بَشِيرٍ ، " أَنَّ أَبَاهُ أَتَى بِهِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : إِنِّي نَحَلْتُ ابْنِي هَذَا غُلَامًا ، فَقَالَ : أَكُلَّ وَلَدِكَ نَحَلْتَ مِثْلَهُ ، قَالَ : لَا ، قَالَ : فَارْجِعْهُ " .
Narrated An-Nu`man bin Bashir: that his father took him to Allah's Apostle and said, "I have given this son of mine a slave." The Prophet asked, "Have you given all your sons the like?" He replied in the negative. The Prophet said, "Take back your gift then."
وَإِذَا أَعْطَى بَعْضَ وَلَدِهِ شَيْئًا لَمْ يَجُزْ حَتَّى يَعْدِلَ بَيْنَهُمْ وَيُعْطِيَ الْآخَرِينَ مِثْلَهُ ، وَلَا يُشْهَدُ عَلَيْهِ ، وَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : اعْدِلُوا بَيْنَ أَوْلَادِكُمْ فِي الْعَطِيَّةِ ، وَهَلْ لِلْوَالِدِ أَنْ يَرْجِعَ فِي عَطِيَّتِهِ وَمَا يَأْكُلُ مِنْ مَالِ وَلَدِهِ بِالْمَعْرُوفِ وَلَا يَتَعَدَّى ، وَاشْتَرَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عُمَرَ بَعِيرًا ، ثُمَّ أَعْطَاهُ ابْنَ عُمَرَ ، وَقَالَ : اصْنَعْ بِهِ مَا شِئْتَ .
And if he gives something as a gift to some of his sons, then until he gives equally to all his sons with justice, this gift will not be valid, and it is also not correct to bear witness to such an unjust gift. The Prophet (peace and blessings of Allah be upon him) said: "Do justice among your children in gifts." And can a father take back his gift? And a father can take from his son's wealth according to custom, provided he does not intend injustice. The Prophet (peace and blessings of Allah be upon him) bought a camel from Umar (may Allah be pleased with him), and then he (peace and blessings of Allah be upon him) gave it to Abdullah bin Umar (may Allah be pleased with them both) and said: "Do with it as you wish."
