The Book of Manumission (of Slaves)

بَابُ إِذَا أُسِرَ أَخُو الرَّجُلِ أَوْ عَمُّهُ هَلْ يُفَادَى إِذَا كَانَ مُشْرِكًا:

Chapter. If the brother or the uncle of somebody was taken as a war prisoner, then can he ransom him if he is a Mushrik?

Hadith 2537
حَدَّثَنَا إِسْمَاعِيلُ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ بْنِ عُقْبَةَ ، عَنْ مُوسَى بْنِ عُقْبَةَ ، عَنِ ابْنِ شِهَابٍ ، قَالَ : حَدَّثَنِي أَنَسٌ رَضِيَ اللَّهُ عَنْهُ ، " أَنَّ رِجَالًا مِنْ الْأَنْصَارِ اسْتَأْذَنُوا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالُوا : ائْذَنْ لَنَا ، فَلْنَتْرُكْ لِابْنِ أُخْتِنَا عَبَّاسٍ فِدَاءَهُ ، فَقَالَ : لَا تَدَعُونَ مِنْهُ دِرْهَمًا " .
Narrated Anas: Some men of the Ansar asked for the permission of Allah's Apostle and said, "Allow us to give up the ransom from our nephew Al-`Abbas. The Prophet said (to them), "Do not leave (even) a Dirham (of his ransom).
وَقَالَ أَنَسٌ : قَالَ الْعَبَّاسُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : فَادَيْتُ نَفْسِي ، وَفَادَيْتُ عَقِيلًا ، وَكَانَ عَلِيٌّ لَهُ نَصِيبٌ فِي تِلْكَ الْغَنِيمَةِ الَّتِي أَصَابَ مِنْ أَخِيهِ عَقِيلٍ ، وَعَمِّهِ عَبَّاسٍ .
Anas (may Allah be pleased with him) said that Abbas (may Allah be pleased with him) said, "I paid my own ransom (for release from captivity after the Battle of Badr) and also that of Aqil (may Allah be pleased with him), even though Ali (may Allah be pleased with him) had a share in that booty which was obtained from his brother Aqil (may Allah be pleased with him) and his uncle Abbas (may Allah be pleased with him)."

وَقَالَ أَنَسٌ : قَالَ الْعَبَّاسُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : فَادَيْتُ نَفْسِي ، وَفَادَيْتُ عَقِيلًا ، وَكَانَ عَلِيٌّ لَهُ نَصِيبٌ فِي تِلْكَ الْغَنِيمَةِ الَّتِي أَصَابَ مِنْ أَخِيهِ عَقِيلٍ ، وَعَمِّهِ عَبَّاسٍ .
