The Book of Quarrels

بَابُ مَنْ بَاعَ عَلَى الضَّعِيفِ وَنَحْوِهِ:

Chapter. If somebody sells a thing for a weak-minded person and pays him the price.

Hadith 2414
، وَيُذْكَرُ عَنْ جَابِرٍ رَضِيَ اللَّهُ عَنْهُ ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَدَّ عَلَى الْمُتَصَدِّقِ قَبْلَ النَّهْيِ ، ثُمَّ نَهَاهُ ، وَقَالَ مَالِكٌ : إِذَا كَانَ لِرَجُلٍ عَلَى رَجُلٍ مَالٌ وَلَهُ عَبْدٌ لَا شَيْءَ لَهُ غَيْرُهُ فَأَعْتَقَهُ لَمْ يَجُزْ عِتْقُهُ ، وَمَنْ بَاعَ عَلَى الضَّعِيفِ وَنَحْوِهِ .
And it is narrated from Jabir (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) rejected a man's charity, then forbade him from giving charity in such a state. And Imam Malik (may Allah have mercy on him) said that if someone owes a debt to another and the debtor has only one slave, and apart from this he has no other property, then if the debtor frees that slave, his emancipation will not be valid.
حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُسْلِمٍ ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ دِينَارٍ ، قَالَ : سَمِعْتُ ابْنَ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، قَالَ : كَانَ رَجُلٌ يُخْدَعُ فِي الْبَيْعِ ، فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِذَا بَايَعْتَ ، فَقُلْ لَا خِلَابَةَ " ، فَكَانَ يَقُولُهُ .
Narrated Ibn `Umar: A man was often cheated in buying. The Prophet said to him, "When you buy something, say (to the seller), No cheating." The man used to say so thenceforward .
فَدَفَعَ ثَمَنَهُ إِلَيْهِ ، وَأَمَرَهُ بِالْإِصْلَاحِ وَالْقِيَامِ بِشَأْنِهِ ، فَإِنْ أَفْسَدَ بَعْدُ مَنَعَهُ لِأَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ إِضَاعَةِ الْمَالِ ، وَقَالَ لِلَّذِي يُخْدَعُ فِي الْبَيْعِ : إِذَا بَايَعْتَ فَقُلْ لَا خِلَابَةَ ، وَلَمْ يَأْخُذْ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَالَهُ .
And he was told to reform himself and to take care of himself, but despite that he wasted his wealth, so the ruler will prevent him from spending. Because the Prophet (ﷺ) forbade the wasting of wealth. And the Prophet (ﷺ) said to the person who used to be deceived in buying and selling, "When you buy or sell, say: 'There is to be no deception.'" The Messenger of Allah (ﷺ) did not take his wealth into his own possession.

Hadith 2415
حَدَّثَنَا عَاصِمُ بْنُ عَلِيٍّ ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ ، عَنْ جَابِرٍ رَضِيَ اللَّهُ عَنْهُ ، " أَنَّ رَجُلًا أَعْتَقَ عَبْدًا لَهُ لَيْسَ لَهُ مَالٌ غَيْرُهُ ، فَرَدَّهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَابْتَاعَهُ مِنْهُ نُعَيْمُ بْنُ النَّحَّامِ " .
Narrated Jabir: A man manumitted a slave and he had no other property than that, so the Prophet canceled the manumission (and sold the slave for him). Nu'aim bin Al-Nahham bought the slave from him.
